What did the High Court hold?

The High Court did not decide the substantial questions of law framed for consideration. This was due to subsequent developments, specifically the enactment of the Direct Tax Vivad Se Vishwas Act, 2020. The Court was informed by the assessee's counsel that the assessee had been issued Form-3 under the Vivad Se Vishwas Act. Consequently, the assessee's counsel sought permission to withdraw the appeal. The High Court granted this permission and dismissed the Tax Case Appeals as withdrawn. No costs were awarded. The operative direction was the dismissal of the appeals as withdrawn.

What were the facts?

The assessee, K. Padma, filed two appeals (TCAs 504 & 505 of 2015) before the High Court of Judicature at Madras against the order dated 12.12.2013 passed by the Income Tax Appellate Tribunal, Madras "A" Bench. These appeals pertained to assessment years 2004-2005 and 2008-2009. The appeals were admitted on substantial questions of law concerning the restoration of penalty under Section 271(1)(c) of the Income Tax Act, 1961. The revenue was represented by the Asst. Commissioner of Income Tax, Central Circle - 1 (2), Chennai. The procedural history leading to the High Court appeal involved the Tribunal's order which is under challenge.

What were the issues?

The High Court was to decide three substantial questions of law, all relating to the Tribunal's order restoring penalty under Section 271(1)(c) of the Income Tax Act, 1961: 1. Whether the Tribunal was right in restoring the penalty when sworn statements indicated the income was earned by the appellant's father and invested in the appellant's name? 2. Whether the Tribunal was right in restoring the penalty when additions were made solely based on an offer by the appellant's father to avoid litigation? 3. Whether Explanation 5A to Section 271(1)(c) is applicable when there was no departmental finding that the assessee owned undisclosed money, bullion, jewellery, or investments, and additions were only based on the father's offer? The assessee argued that the penalty restoration was incorrect given the circumstances of income origin and the basis of additions. The revenue's contentions are not explicitly recorded in the provided text, beyond their representation by senior counsel.

Which sections of the Income-tax Act were involved?

Section 260A,Section 271(1)(c)
