M/S.S4 CARLISLE PUBLISHING S vs. COMMISSIONER OF INCOME TAX 6
What did the High Court hold?
The High Court noted that the learned counsel for the appellant-assessee submitted that the case of the assessee has been accepted by the Assessing Officer as on date, and therefore, they wished to withdraw the appeal. The Court took the e-mail to that effect on record. The assessee's counsel further submitted that in the event of any action initiated by the Commissioner of Income Tax under Section 263 of the Act, the appellant's right to contest should not be foreclosed. The High Court observed that the assessee need not have any such apprehension, as the stand taken by the assessee has been accepted. The Court stated that if anything has to be done at a higher level, the statutory remedy available to the assessee would be fully available and cannot be foreclosed. Consequently, the Tax Case Appeal was dismissed as withdrawn, with no costs.
What were the facts?
The assessee, M/s.S4 Carlisle Publishing Service P Ltd, filed an appeal before the High Court of Judicature at Madras against an order dated 28.06.2018 passed by the Income Tax Appellate Tribunal, Madras 'A' Bench. The appeal pertains to the assessment year 2008-09. The Revenue is represented by the Commissioner of Income Tax 6, Chennai. The appeal challenges the Tribunal's order, which had remitted the case back to the Assessing Officer for further examination regarding the valuation of shares. The assessee had raised substantial questions of law concerning the addition made under Section 68 of the Income Tax Act, 1961, and the perversity of the Tribunal's order in remitting the case back.
What were the issues?
1. Whether, under the facts and circumstances, the Tribunal was right in not holding that the addition made under Section 68 of the Income Tax Act, 1961, is unsustainable, particularly when the appellant had explained the credit to the share capital and share premium account with material evidence? (Assessee's contention: The addition under Section 68 is not sustainable as the credit was explained with material evidence.) 2. Is the order of the Tribunal in remitting the case back to the Assessing Officer perverse, particularly when all material evidence was before it? (Assessee's contention: Remittal is perverse as all evidence was already presented.) 3. Whether, on facts and circumstances, the Tribunal was right in remitting the case back to the Assessing Officer with a direction to examine the valuation of shares, when the issue before the Tribunal was not on the value of shares but whether an addition could be made under Section 68 when the credit was fully explained? (Assessee's contention: Remittal for share valuation is incorrect as the primary issue was the sustainability of addition under Section 68.) 4. Is the Tribunal right in remitting the case back to the Assessing Officer to examine the valuation of shares, particularly when in the earlier year, the appellant had issued shares to Indian promoters at a price very close to the price at which shares were issued to non-residents in the impugned year, and all records were before the Tribunal? (Assessee's contention: Remittal for share valuation is inappropriate given prior year's comparable share issuance and availability of all records.) The Revenue's contentions are not recorded in the judgment.
