M/S.AVM FILM STUDIOS vs. INCOME TAX OFFICER
What did the High Court hold?
The High Court did not decide the substantial question of law. The Court noted the enactment of the Direct Tax Vivad Se Vishwas Act, 2020, and was informed that the assessee had filed the requisite Forms 1 & 2 under Section 4 of the Act. Consequently, the appeals were disposed of on the ground that the assessee had availed the benefit of the Act. The Court directed the Department to process the application at the earliest. The assessee was granted liberty to restore the appeals if the decision under the Vivad Se Vishwas Act was not in their favour. The substantial question of law was left open. No operative directions were issued regarding deletion or remand as the matter was settled under the Vivad Se Vishwas Act.
What were the facts?
The assessee, M/s. AVM Film Studios, filed three appeals before the High Court of Judicature at Madras against the order of the Income Tax Appellate Tribunal (ITAT), Madras 'B' Bench, dated 08.07.2015. These appeals pertained to Assessment Years 2008-09, 2007-08, and 2011-12. The appeals were admitted on 25.01.2016 on a substantial question of law. Subsequently, the Government of India enacted the Direct Tax Vivad Se Vishwas Act, 2020. The assessee informed the Court that they had filed requisite Forms 1 & 2 under Section 4 of this Act on 10.12.2020.
What were the issues?
1. Whether the Tribunal is right in holding that the receipt of money in entirety upon lease of distribution, execution of pictures, assignment of VEO rights, etc., is taxable as income upon the interpretation of Sections 4, 5 and 145 of the Income Tax Act, 1961, and that the income admitted by the assessee on a proportionate basis is not acceptable? Assessee's contention: The judgment does not record any specific contentions made by the assessee regarding the substantial question of law. However, the framing of the question implies the assessee likely argued that the entirety of the receipts should not be taxed as income, and proportionate taxation was acceptable. Revenue's contention: The judgment does not record any specific contentions made by the Revenue regarding the substantial question of law. However, the framing of the question implies the Revenue likely argued that the entirety of the receipts were taxable as income.

The Government of India enacted the Direct Tax Vivad Se Vishwas Act, 2020 (Act 3 of 2020) to provide for resolution of disputed tax and for matters connected therewith or incidental thereto. The Act of the Parliament received the assent of the President on 17th March 2020 and published in the Gazette of India on 17th March 2020. 4.
