PRINCIPAL COMR OF INCOME TAX vs. M/S. SANGUPATHI PROPERTIES L
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue on the grounds of low tax effect, as per CBDT Circular No. 17/2019. The Court noted the submission by the Revenue's counsel that the tax effect was below the increased monetary limit for filing appeals before the High Court. Consequently, the substantial questions of law framed at the time of admission were left open. The Revenue was granted liberty to file a petition to restore the appeal if the tax effect was found to be above the threshold limit fixed in the circular, allowing it to be heard and decided on merits. No costs were awarded.
What were the facts?
The Revenue, represented by the Principal Commissioner of Income Tax, Central 2, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 08.03.2019 passed by the Income Tax Appellate Tribunal (ITAT), Madras 'B' Bench. The appeal pertains to the assessment year 2014-15 and challenges the ITAT's confirmation of the CIT(A)'s direction to delete a liability of Rs. 2,76,40,000/-. The assessee is M/s. Sangupathi Properties Pvt Ltd. The High Court admitted the appeal on substantial questions of law.
What were the issues?
The High Court was to decide two substantial questions of law: 1. Whether the ITAT's conclusion that the CIT(A) rightly directed the deletion of a liability of Rs. 2,76,40,000/- was correct, despite the assessee not proving the identity, genuineness, and creditworthiness of persons who provided land advances, even during appellate proceedings? 2. Whether the ITAT, as the highest fact-finding authority, was correct in confirming the CIT(A)'s order without adjudicating grounds 2.1, 2.2, and 2.3 raised by the Department? The Revenue argued that the appeal was not being pursued due to low tax effect, citing CBDT Circular No. 17/2019, which increased the monetary limit for appeals to the High Court to Rs. 1 Crore. The Revenue stated that the tax effect in this case was below this threshold. The judgment does not record any specific arguments from the assessee regarding the substantial questions of law.
