M.BABULAL GULECHA vs. DEPUTY COMMISSIONER OF
What did the High Court hold?
The High Court noted that it was not necessary to decide the substantial questions of law due to subsequent developments. The enactment of the Direct Tax Vivad Se Vishwas Act, 2020, provided a mechanism for the resolution of disputed tax. The assessee's counsel informed the Court that Form-3 had been issued to the assessee under this Act and sought permission to withdraw the appeal. Consequently, the High Court dismissed the Tax Case Appeal as withdrawn. No specific finding was given on the substantial questions of law as the appeal was disposed of on procedural grounds. The operative direction was the dismissal of the appeal as withdrawn.
What were the facts?
The assessee, M. Babulal Gulecha, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 30.12.2013 passed by the Income Tax Appellate Tribunal (ITAT), Madras "C" Bench. This order was in relation to Miscellaneous Petition No. 180/Mds/2013 in I.T.A. No. 1993/Mds/2011 for the assessment year 2006-07. The High Court admitted the appeal on substantial questions of law. Subsequently, the Direct Tax Vivad Se Vishwas Act, 2020, was enacted. The assessee informed the Court that they had been issued Form-3 under this Act and sought to withdraw the appeal.
What were the issues?
The High Court was to decide the following substantial questions of law: 1. Whether the Appellate Tribunal was right in dismissing the Miscellaneous Petition without considering the specific plea raised in the petition and deciding it on an extraneous issue? 2. Whether the Tribunal was right in holding that the petitioner seeks review of the order while the plea for an opportunity remains unanswered? 3. Whether the Tribunal was correct, in law, in not deleting the addition although the lack of sufficient opportunity to produce him amounts to a violation of natural justice? The assessee contended that the ITAT wrongly dismissed their Miscellaneous Petition without addressing the specific pleas and by deciding on an extraneous issue, thereby violating natural justice. The assessee argued that their plea was not for a review but for an unanswered opportunity. The revenue's contentions are not recorded in the judgment.
