COMMISSIONER OF INCOME TAX vs. TAMILNADU TENNIS ASSOCIATION
What did the High Court hold?
The High Court, in light of the submission by the Revenue's learned Standing Counsel regarding CBDT Circular No. 17/2019, which sets a monetary threshold for pursuing appeals before the High Court, noted that the tax effect in this appeal was below the stipulated limit of Rs. 1,00,00,000/-. Consequently, the Court dismissed the appeal as withdrawn. The substantial questions of law were kept open for determination in an appropriate case. No costs were awarded. The connected miscellaneous petition was also closed.
What were the facts?
The Commissioner of Income Tax, Chennai (Revenue) filed a Tax Case Appeal before the High Court of Judicature at Madras, challenging an order dated 28.11.2014 passed by the Income Tax Appellate Tribunal (ITAT), 'C' Bench, Chennai. The appeal pertained to assessment year 2009-10 and concerned the assessee, Tamil Nadu Tennis Association. The ITAT's order was in relation to ITA No. 1757/Mds/2013. The appeal was admitted and MP No. 1 of 2015 was filed. The High Court was to decide substantial questions of law raised by the Revenue.
What were the issues?
The High Court was to decide the following substantial questions of law: 1. Whether the ITAT was correct in holding that the assessee's activities fall under the first limb of the definition of charity as 'education' under Section 2(15) of the Income Tax Act, 1961, and not under 'advancement of any other object of general public utility', thereby not falling under the provisos to Section 2(15)? 2. Whether the ITAT was correct in holding that the assessee functions as an arm of the Government of India under the supervision of the Ministry of Youth Affairs and Sports? Contentions: The Revenue, through its learned Standing Counsel, brought to the court's notice CBDT Circular No. 17/2019 dated 08.08.2019. This circular stipulates that appeals shall not be filed or pursued before the High Court if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue submitted that the tax effect in the present appeal is less than this threshold limit.
