PRINCIPAL COMMISSIONER OF IN vs. M/S.VYSA PLOT AND HOUSING PV
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue. The dismissal was based on the submission made by the Revenue that the appeal was not being pursued due to a low tax effect, citing CBDT Circular No. 17/2019. This circular increased the monetary limit for filing or pursuing appeals before the High Court to Rs. 1 Crore, and the tax effect in this case was stated to be below this threshold. Consequently, the substantial questions of law framed for the appeal were left open. The Revenue was granted liberty to file a petition to restore the appeal if the tax effect was found to be above the threshold limit in the future. No costs were imposed.
What were the facts?
The Revenue, Principal Commissioner of Income Tax, Central 2, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 08.03.2019 passed by the Income Tax Appellate Tribunal (ITAT), Madras 'B' Bench. The appeal pertained to assessment year 2014-15 and challenged the ITAT's confirmation of the CIT(A)'s direction to delete a liability of Rs. 2,25,15,000/-. The assessee is M/s. Vysa Plot & Housing Pvt. Ltd. The High Court admitted the appeal on substantial questions of law. Subsequently, the Revenue sought to withdraw the appeal due to low tax effect, citing CBDT Circular No. 17/2019 which increased the monetary limit for appeals to the High Court to Rs. 1 Crore.
What were the issues?
1. Whether on the facts and in the circumstances of the case, the ITAT's conclusion that the CIT(A) has rightly directed the Assessing Officer to delete the liability of Rs. 2,25,15,000/- was correct, despite the assessee not proving the identity, genuineness, and creditworthiness of persons who purportedly provided land advances, even during appellate proceedings? (Question of law and fact, concerning Section 68 of the Income Tax Act, 1961). 2. Whether on the facts and in the circumstances of the case, the ITAT, being the highest fact-finding authority, was correct in law in confirming the learned CIT(A)'s order without adjudicating grounds 2.1, 2.2, and 2.3 raised by the Department? (Question of law). Assessee's contentions: Not recorded in the judgment. Revenue's contentions: The appeal is not pursued due to low tax effect, as per CBDT Circular No. 17/2019, because the tax effect is below the increased threshold limit of Rs. 1 Crore for appeals to the High Court.
