What did the High Court hold?

The High Court noted that during the pendency of the appeals, the assessee had availed the benefit of the Direct Tax Vivad Se Vishwas Act, 2020. The assessee had filed the necessary declarations (Forms 1 and 2 under Section 4(1)), which were accepted by the Income Tax Department, and Form 3 was issued on 02.11.2020. The Revenue fairly conceded this development. In view of the assessee having opted for and received the benefits under the Vivad Se Vishwas Act, the Court found it unnecessary to decide the substantial questions of law raised in the appeals. The appeals were disposed of based on the submissions made by both sides, with a direction to the department to process the applications under the Act at the earliest and communicate the decision to the assessee. No costs were awarded.

What were the facts?

The assessee, Shri R. Panneerselvam, filed these Tax Case Appeals before the High Court of Judicature at Madras, challenging an order dated 04.09.2015 passed by the Income Tax Appellate Tribunal (ITAT), 'C' Bench, Chennai. The appeals pertain to Assessment Years 2003-04, 2005-06, 2006-07, and 2007-08. The Revenue is represented by the Assistant Commissioner of Income Tax. During the pendency of these appeals, the assessee submitted Forms 1 and 2 under Section 4(1) of the Direct Tax Vivad Se Vishwas Act, 2020, which were accepted by the Income Tax Department, and Form 3 was issued to the assessee on 02.11.2020. The assessee filed a memo to this effect, which was conceded by the Revenue.

What were the issues?

The Tribunal had to decide the following substantial questions of law: 1. Whether the Appellate Tribunal was correct in law in partly sustaining the addition on the presumption of sales suppression, establishing perversity in its findings due to misconstruction of scrutinized details and overlooking trade practices. 2. Whether the Appellate Tribunal was correct in law in confirming the estimation of lodging receipts without justifying the basis or establishing the reasonableness of such an estimate for addition to taxable total income. 3. Whether the Appellate Tribunal was correct in sustaining additions made by extrapolating survey results to earlier Assessment Years, despite no reasons for presuming sales suppression or room rent and without supporting materials from the survey. The Assessee contended that they have availed the benefit of the Direct Tax Vivad Se Vishwas Act, 2020, by filing the requisite forms which were accepted and Form 3 was issued. The Revenue conceded this submission.
