M/S.BHAVANI DISTILLERIES AND vs. THE ASSISTANT COMMISSIONER O
What did the High Court hold?
The High Court noted that the assessee had availed the benefit under the Direct Tax Vivad Se Vishwas Act, 2020, by filing the requisite forms. Consequently, the Court deemed it unnecessary to decide the substantial question of law. The appeal was disposed of with the observation that the Department should process the assessee's application under the Act at the earliest. The assessee was granted liberty to restore the appeal in the event the ultimate decision on their declaration under Section 4 of the Vivad Se Vishwas Act is not in their favour. The substantial question of law was left undecided.
What were the facts?
The assessee, M/s. Bhavani Distillers and Chemicals Ltd., filed an appeal before the High Court of Judicature at Madras against an order dated 14.11.2017 passed by the Income Tax Appellate Tribunal, Chennai Bench “C”. The appeal pertains to Assessment Year 2007-2008. The dispute concerns the tax treatment of additional compensation received by the assessee for foregoing farming rights over agricultural land. The assessee had filed the necessary forms under the Direct Tax Vivad Se Vishwas Act, 2020, on 30.01.2021.
What were the issues?
1. Whether, on the facts and circumstances of the case, the Appellate Tribunal was right in law in holding that the additional compensation received by the Appellant for foregoing their 'farming rights' over agricultural land is to be treated as agricultural income only to the extent of the estimated value of standing crops that existed on the agricultural land at the time of cancellation of the JVF agreement and to treat the balance compensation as income under the head 'Short Term Capital Gains'? Assessee's Contention: The judgment does not record specific contentions made by the assessee regarding the substantial question of law. However, the framing of the question implies the assessee likely argued for the entire compensation to be treated as agricultural income. Revenue's Contention: The judgment does not record specific contentions made by the revenue regarding the substantial question of law. However, the Tribunal's decision, as reflected in the question, suggests the revenue argued for a portion of the compensation to be treated as capital gains.

In the light of the fact that the assessee has already availed the benefit under the Act, no useful purpose would be served in keeping this appeal pending. Accordingly, the Tax Case Appeal is disposed of on the ground that the assessee has already filed the requisite Forms 1 & 2 and the Department shall process the application at the earliest in accordance with the said Act and communicate the decision to the assessee at the earliest. As observed, the assessee is given liberty to restore this appeal in the event the ultimate decision to be taken on the declaration filed by the assessee under Section 4 of the said Act is not in favour of the assessee. If such a prayer is made, the Registry shall entertain the prayer without insisting upon any application to be filed for condonation of delay in restoration of the appeal and on such request made by the assessee by filing a Miscellaneous Petition for Restoration, the Registry shall place such petition before the Division Bench for orders.
