What did the High Court hold?

The High Court dismissed the appeal filed by the Revenue. The dismissal was based on the submission made by the Revenue's counsel regarding the low tax effect, as per CBDT Circular No. 17/2019. The Court noted that the monetary limit for filing or pursuing an appeal before the High Court had been increased to Rs. 1 Crore, and the tax effect in this specific case was below that limit. Consequently, the substantial questions of law framed for the appeal were left open. The Revenue was granted liberty to mention the case for restoration if the tax effect was found to be above the threshold limit fixed in the circular, to be heard and decided on merits. No costs were awarded.

What were the facts?

The Revenue, Commissioner of Income Tax, Corporate Circle 3(2), Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated August 7, 2015, passed by the Income Tax Appellate Tribunal, Chennai 'C' Bench. The appeal pertained to assessment year 2010-11 and challenged the Tribunal's decision regarding the assessee, M/s. Vimkar Contract Works Pvt. Ltd., Chennai. The core of the dispute involved the assessee's eligibility for deductions under Section 80IB(4) of the Income Tax Act. The Revenue's appeal was admitted on June 28, 2016, on two substantial questions of law.

What were the issues?

1. Whether, on the facts and circumstances of the case, the Tribunal was right in holding that the assessee is entitled to the benefit of Section 80IB(4) even though the assessee company is manufacturing the good only as a work contractor in the premises rented out by the principal and that too, under the supervision of the principal? 2. Whether, on the facts and circumstances of the case, the Tribunal was right in holding that the Explanation at the end of Section 80IA, which states that a person, who executes works contract, could not be given the benefit, cannot be made applicable to cases that fall under Section 80IB? Assessee's arguments: Not recorded in the judgment. Revenue's arguments: The Revenue submitted that the appeal was not being pursued due to low tax effect, citing CBDT Circular No. 17/2019 which increased the monetary limit for filing appeals before the High Court to Rs. 1 Crore. The tax effect in this case was stated to be below this threshold.
