M/S.S.V.P.N.S.N.BALASIVAJI N vs. THE INCOME TAX OFFICER
What did the High Court hold?
The High Court disposed of the tax case appeals with liberty granted to the assessee to restore them if the ultimate decision on their declaration filed under the Vivad Se Vishwas Scheme is not in their favour. The Court stated that if such a prayer is made, the Registry shall entertain it without requiring a condonation of delay application and place it before the appropriate Division Bench. Consequently, the substantial questions of law framed were left open and not decided on merits. The operative direction is to dispose of the appeals with the aforementioned liberty, and no costs were awarded.
What were the facts?
The assessee, M/s.S.V.P.N.S.N.Balasivaji Nadar & Sons, filed three appeals before the High Court of Judicature at Madras against the common order dated 12.07.2019 passed by the Income Tax Appellate Tribunal, 'D' Bench, Chennai. These appeals, TCA.Nos.429 to 431 of 2020, pertain to assessment years 2009-10, 2010-11, and 2011-12. The appeals were admitted on 18.12.2020, raising substantial questions of law concerning the invocation of Section 147 of the Income Tax Act, 1961, and the reliance on co-ordinate bench decisions. During the pendency of these appeals, the assessee filed a declaration/undertaking under the Vivad Se Vishwas Scheme, and orders were passed in Form No.3.
What were the issues?
The Tribunal had to decide the following substantial questions of law: 1. Whether the provisions of Section 147 of the Income Tax Act, 1961, were validly invoked based on borrowed satisfaction, particularly in the absence of independent satisfaction by the Assessing Officer regarding information received from the Maharashtra VAT Department regarding the escapement of taxable total income. 2. Whether the decisions of co-ordinate benches relied upon by the assessee should warrant a consistent decision, considering the law declared by the Supreme Court and the High Court, and the principles of judicial discipline. The assessee argued that Section 147 was not validly invoked due to borrowed satisfaction and that consistent decisions should be followed based on judicial discipline. The revenue's contentions are not recorded in the judgment.
