COMMISSIONER OF INCOME TAX vs. M/S. SICGIL INDIA LTD.,
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue on account of low tax effect, as per the submissions made by the Revenue's counsel. The Court noted that the substantial question of law raised in the appeal was left open. The Revenue was granted liberty to mention the case for restoration if the tax effect was found to be above the threshold limit fixed in the CBDT circular, for the appeal to be heard and decided on merits. No costs were imposed. The specific finding of the ITAT on the substantial question of law, which was the subject of the appeal, was not adjudicated upon by the High Court.
What were the facts?
The Commissioner of Income Tax, Chennai (Revenue) filed an appeal before the High Court of Judicature at Madras against an order dated 29.9.2015 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'B' Bench. The appeal concerned the assessment year 2010-11 and challenged the ITAT's decision regarding the computation of deduction under Section 80IB. The dispute centered on whether cylinder transport charges received by M/s. SICGIL India Ltd. (assessee) for delivering finished products had a direct nexus with its industrial undertaking and were integral to its turnover for deduction purposes. The Revenue's appeal was filed under Section 260A of the Income Tax Act, 1961.
What were the issues?
1. Whether, on the facts and in the circumstances of the case, the Tribunal was right in holding that the cylinder transport charges received for delivery of the finished product has direct nexus with the industrial undertaking and is integral part of the turnover for the purpose of computation of deduction under Section 80IB? The Revenue argued that the appeal was not being pursued due to low tax effect, citing CBDT Circular No. 17/2019 which increased the monetary limit for appeals to the High Court to Rs. 1 Crore. The Revenue stated that the tax effect in this case was below this threshold. The judgment does not record any specific arguments from the assessee regarding the merits of the substantial question of law.
