THE COMMISSIONER OF INCOME T vs. M/S.FINANCIAL SOFTWARE AND S
What did the High Court hold?
The High Court did not decide the substantial questions of law on their merits. The Revenue's counsel submitted that the appeal was not being pursued due to a low tax effect, citing CBDT Circular No. 17/2019 which increased the monetary limit for pursuing appeals before the High Court to Rs. 1 Crore. As the tax effect in this case was below this threshold, the High Court dismissed the appeal on this ground. The substantial questions of law were expressly left open. Liberty was granted to the Revenue to seek restoration of the appeal if the tax effect was found to be above the threshold limit, for a decision on merits. No costs were awarded.
What were the facts?
The Revenue, represented by the Commissioner of Income Tax, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated June 22, 2016, passed by the Income Tax Appellate Tribunal (ITAT), Madras 'A' Bench. The appeal pertained to the assessment year 2010-11 and concerned the assessee, M/s. Financial Software and Systems (P) Ltd., Chennai. The core of the dispute involved foreign remittances made by the assessee for software purchases without deducting withholding tax. The ITAT's order, which the Revenue challenged, had ruled against the Revenue on certain aspects of these remittances.
What were the issues?
The Tribunal was asked to decide three substantial questions of law: 1. Whether, on the facts and in the circumstances of the case, the Tribunal was right in holding that the proceeding under Section 201(1) holding the assessee in default was not applicable to foreign remittance made towards purchase of software without effecting withholding tax under Section 195 is proper? 2. Whether the foreign remittance made to companies by the assessee without deducting withholding taxes under Section 195 of the Income Tax Act, 1961 in respect of purchase of software can be treated as royalty on which TDS is to be made? 3. Whether the disallowance made under Section 40(a)(i) and the order passed under Section 201(1)/201(1A) are independent and different proceedings? The Revenue argued that the ITAT's decision on these points was incorrect. The Assessee's contentions were not recorded in the judgment.
Which sections of the Income-tax Act were involved?
Section 260A,Section 201(1),Section 195,Section 40(a)(i),Section 201(1A)
