COMMISSIONER OF INCOME TAX vs. SRI KRITHIKA ENTERPRISES
What did the High Court hold?
The High Court dismissed the appeals filed by the Revenue. The dismissal was based on the submission by the Revenue's counsel that the appeals were not being pursued due to a low tax effect, falling below the threshold limit stipulated in CBDT Circular No.17/2019. This circular increased the monetary limit for filing or pursuing appeals before the High Court to Rs.1 Crore. Consequently, the substantial questions of law raised in both appeals were left undecided. The Court granted liberty to the Revenue to seek restoration of the appeals if the tax effect was found to be above the threshold limit, allowing them to be heard and decided on merits. No costs were awarded.
What were the facts?
These appeals were filed by the Revenue against orders of the Income Tax Appellate Tribunal (ITAT) dated 09.02.2007 and 10.01.2007. These orders pertained to block assessment periods: 01.04.1988 to 18.03.1999 for TCA.No.413/2020 and 01.04.1990 to 08.02.2001 for TCA.No.414/2020. The appeals were filed by the Commissioner of Income Tax, Salem, against Sri Krithika Enterprises and M. Ponnusamy respectively. The appeals were filed under Section 260A of the Income Tax Act, 1961.
What were the issues?
The Tribunal had to decide two substantial questions of law. 1. TCA.No.413 of 2020: Whether the Tribunal was correct in deleting the penalty levied under Section 158BFA on inflated agricultural income, which was not declared by the assessee in Form 2D, and on a deficiency in closing stock found during a physical verification search. 2. TCA.No.414 of 2020: Whether the Tribunal was correct in upholding the CIT(A)'s direction not to treat the disclosed income as NIL as per Section 158BB(1)(ca) read with Clause (a) of Section 158B, given that the assessee's salary income was above the exemption level and no TDS was made on it. The Revenue argued that the appeals were not being pursued due to low tax effect, citing CBDT Circular No.17/2019 which increased the monetary limit for High Court appeals to Rs.1 Crore. The tax effect in both cases was stated to be below this threshold. No arguments were recorded for the assessees.
