THE INCOME TAX OFFICER vs. SHRI JAYARAMAN MUTHUKUMAR
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue on account of low tax effect, as per the submissions made by the Revenue's counsel. The Court noted that the Revenue relied on CBDT Circular No. 17/2019, which stipulates a monetary limit of Rs. 1 Crore for appeals before the High Court, and that the tax effect in this case was below that limit. Consequently, the substantial question of law raised by the Revenue was left open. The Court granted liberty to the Revenue to file a petition to restore the appeal for hearing and decision on merits if the tax effect was found to be above the threshold limit fixed in the circular. No costs were awarded. The issue regarding the Tribunal's deletion of the penalty under Section 271(1)(c) was not decided on merits.
What were the facts?
The Revenue, specifically the Principal Commissioner of Income Tax-2, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated February 6, 2019, passed by the Income Tax Appellate Tribunal, Chennai 'A' Bench. The appeal pertained to assessment year 2010-11. The core of the dispute involved the Tribunal's deletion of a penalty levied by the Assessing Officer under Section 271(1)(c) of the Act. The Revenue's appeal was filed while a quantum appeal, on which the Department had preferred a further appeal under Section 260A, was pending and had not reached finality. The tax effect in this case was stated to be below the threshold limit for pursuing appeals before the High Court, as per CBDT Circular No. 17/2019.
What were the issues?
1. Whether, on the facts and circumstances of the case and in law, the Tribunal was right in deleting the penalty levied by the Assessing Officer under Section 271(1)(c) of the Income Tax Act, 1961, when the quantum appeal, on which the Department has preferred further appeal under Section 260A of the Act before this Court, is pending for disposal and has not reached finality? (Question of law) Assessee's Contentions: The judgment does not record any specific contentions made by the assessee. The appeal was dismissed based on the Revenue's submission regarding low tax effect. Revenue's Contentions: The Revenue submitted that the appeal was not being pursued due to the low tax effect, citing CBDT Circular No. 17/2019, which increased the monetary limit for filing or pursuing appeals before the High Court to Rs. 1 Crore. The tax effect in this case was less than this threshold.
