SHRI. P.K.DURAISAMY vs. THE ASSISTANT COMMISSIONER O
What did the High Court hold?
The High Court disposed of the appeal with liberty to the assessee to restore it if the decision under the Vivad Se Vishwas Scheme is not in their favour. Consequently, the substantial questions of law framed were left undecided. The operative direction was to dispose of the appeal with the aforementioned liberty, and no costs were awarded. The judgment did not provide any findings or reasoning on the merits of the substantial questions of law, as they were expressly left open.
What were the facts?
The assessee, Shri P.K. Duraisamy, filed an appeal under Section 260A of the Income Tax Act, 1961, against the order dated 30.1.2019 passed by the Income Tax Appellate Tribunal (ITAT), Chennai. The appeal pertains to the assessment year 2008-09. The substantial questions of law were admitted on 22.7.2020. During the pendency of the appeal before the High Court, the assessee filed a declaration/undertaking under the Vivad Se Vishwas Scheme, and orders were passed on 11.1.2021. The High Court, in light of this subsequent event, disposed of the appeal with liberty to the assessee to restore it if the decision on the Vivad Se Vishwas declaration is not in their favour.
What were the issues?
The Tribunal had to decide on four substantial questions of law: 1. Whether penalty under Section 271AAA of the Act is justifiably leviable when the show cause notice initiating proceedings was flawed? 2. Whether the ITAT has the power to deviate from the decisions of the jurisdictional High Court and its own jurisdictional Bench on identical questions of law? 3. Whether Section 271AAA of the Act can be invoked/levied despite the assessee satisfying the conditions for the exceptions provided in the said penal provision? 4. Whether the ITAT was correct in confirming the levy of penalty under Section 271AAA of the Act, given that the assessee surrendered undisclosed income in the return based on statements under Section 132(4) and complied with other consequential conditions? Assessee's contentions: The assessee argued that the penalty under Section 271AAA was not leviable due to flawed initiation of proceedings, the applicability of exceptions under the said section, and compliance with conditions for surrender of income. The assessee also questioned the ITAT's power to deviate from jurisdictional precedents. Revenue's contentions: The judgment does not record specific contentions made by the Revenue.
