MARUTHI POLY BAGS PVT LTD vs. THE DEPUTY COMMISSIONER OF I
What did the High Court hold?
The High Court noted that the assessee had filed declarations under the Vivad Se Vishwas Scheme, 2020, and was awaiting orders. Consequently, the Court directed the Competent Authority to process these applications expeditiously. The appeals were disposed of with liberty granted to the assessee to restore them if the ultimate decision under the Vivad Se Vishwas Act was not in their favour. If such a prayer was made, the Registry was instructed to entertain it without requiring condonation of delay. The substantial questions of law were left undecided. No costs were awarded. The operative direction was to dispose of the appeals with liberty to restore.
What were the facts?
The assessee, Maruthi Poly Bags P. Ltd., filed appeals before the High Court of Judicature at Madras against the common order dated 09.10.2019 passed by the Income Tax Appellate Tribunal (ITAT), Chennai. These appeals, TCA.Nos.402 to 404 of 2020, pertain to assessment years 2009-10, 2010-11, and 2011-12. The appeals were filed under Section 260A of the Income Tax Act, 1961, challenging the ITAT's decision which upheld additions made by lower authorities. The Revenue was represented by the Deputy Commissioner of Income Tax, Circle 3(1), Trichy. During the pendency of the appeals, the assessee filed declarations under the Vivad Se Vishwas Scheme.
What were the issues?
The High Court was to decide the following substantial questions of law: 1. Whether the Tribunal was correct in law in holding that the additions made by the lower authorities were correct? 2. Whether the Tribunal was right in law in holding that information received from the Central Excise Authorities justified reopening the income tax assessment? 3. Whether the Tribunal was correct in law in holding that the computation made by the appellant was not sustainable in law? 4. Whether the order of the Tribunal was right in law and perverse when it concluded that the sales in question were unaccounted and warranted addition for the assessment years under consideration? The assessee argued that declarations under the Vivad Se Vishwas Scheme were filed on 09.09.2020 and 23.09.2020, and orders were awaited. The Revenue did not record any specific arguments in the judgment.
