What did the High Court hold?

The High Court dismissed the appeal filed by the Revenue on the ground of low tax effect, citing CBDT Circular No.17/2019 which increased the monetary limit for filing appeals before the High Court to Rs.1 Crore. The Court noted that the tax effect in this case was below the threshold limit. Consequently, the substantial question of law framed at the time of admission was left open. Liberty was granted to the Revenue to seek restoration of the appeal if the tax effect was found to be above the threshold limit, to be heard and decided on merits. No costs were awarded.

What were the facts?

The Revenue, represented by the Commissioner of Income Tax, Virudhunagar Circle, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 30.9.2015 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'C' Bench. The appeal pertained to the assessment year 2009-10 and concerned the deletion of an addition made under Section 2(22)(e) of the Act. The assessee is M/s.M.U.A.Arumuga Perumal & Sons. The High Court admitted the appeal on a substantial question of law.

What were the issues?

1. Whether, on the facts and circumstances of the case and in law, the Income Tax Appellate Tribunal was correct in deleting the addition made under Section 2(22)(e) of the Income Tax Act, which provides that not only payment by a private company by way of advance to shareholders, but also payment by lenders to a borrowing firm, in which shareholders having substantial shareholding in the lending company and the partners of the borrowed firm are common, will attract deemed dividend under Section 2(22)(e)? Assessee's contentions: Not recorded. Revenue's contentions: The Revenue argued that the ITAT erred in deleting the addition made under Section 2(22)(e), contending that the provision applies even when payments are made by lenders to a borrowing firm where there is commonality of substantial shareholders in the lending company and partners in the borrowing firm.
