PRINCIPAL COMMISSIONER OF vs. M/S. SAKTHI SUGERS LTD.,
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue. The dismissal was based on the submission by the Revenue's counsel that the appeal was not being pursued due to a low tax effect, falling below the threshold limit stipulated in CBDT Circular No. 17/2019, which increased the monetary limit for filing appeals before the High Court to Rs. 1 Crore. Consequently, the substantial question of law framed for the appeal was left undecided. The Court granted liberty to the Revenue to seek restoration of the appeal if the tax effect was found to be above the threshold limit, allowing it to be heard and decided on merits. No costs were awarded.
What were the facts?
The Revenue, Principal Commissioner of Income Tax-1, Coimbatore, filed an appeal under Section 260A of the Income Tax Act, 1961, against the order dated 23.6.2017 passed by the Income Tax Appellate Tribunal, Chennai 'C' Bench. The appeal pertains to the assessment year 2010-11 and challenges the Tribunal's decision to allow depreciation on plant and machinery of the assessee's Sivagangai Beverages Unit. The core of the dispute is whether depreciation is allowable when the unit had not commenced commercial production and the assets were not 'put to use' for production. The amount in dispute is not explicitly stated but is referred to as having a low tax effect.
What were the issues?
1. Whether the Appellate Tribunal is right in allowing depreciation on the plant and machinery of the Sivagangai Beverages Unit of the assessee, when that unit never commenced commercial production and the assets were not 'put to use' for production? (Question of law and fact, concerning Section 32 of the Income Tax Act, 1961). Contentions: Assessee: Not recorded in the judgment. Revenue: The Revenue argued that depreciation should not be allowed as the unit had not commenced commercial production and the assets were not 'put to use' for production, as stipulated by Section 32 of the Act. However, the Revenue later withdrew its appeal on grounds of low tax effect, citing CBDT Circular No. 17/2019.
