What did the High Court hold?

The High Court held that the issue raised in the appeal is covered by its previous decisions in the case of M/s. Comstar Automotive Technologies Private Ltd. Vs. DCIT [TCA.No.228 of 2011 dated 18.3.2020] and CIT Vs. M/s. Comstar Automotive Technologies Pvt. Ltd. [TCA.No.301 of 2019 dated 06.7.2020]. In these cited cases, a similar substantial question of law was decided in favour of the assessee. Consequently, following these precedents, the High Court dismissed the appeal filed by the Revenue and answered the substantial question of law against the Revenue. No costs were awarded.

What were the facts?

The Revenue, Commissioner of Income Tax, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against the order dated March 29, 2017, passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'C' Bench. The appeal pertains to the assessment year 2005-06 and concerns the assessee, M/s. Allsec Technologies Ltd., Chennai. The High Court admitted the appeal on a substantial question of law. The procedural history indicates that the ITAT had previously passed an order in ITA.No.2229/Mds/2016, which is now under challenge before the High Court.

What were the issues?

1. Whether deduction under Section 10A of the Income Tax Act, 1961, may be allowed without reducing the brought forward losses pertaining to the year subsequent to the assessment year and setting the same off against gains of business in the current year? The Revenue's contention is not explicitly recorded in the judgment. The assessee's contention is also not explicitly recorded. However, the substantial question of law framed indicates the dispute revolves around the treatment of brought forward losses in relation to Section 10A deductions for the assessment year 2005-06. The core issue is whether losses from subsequent years should be set off against current year's business gains before calculating the Section 10A deduction.
