THE COMMISSIONER OF INCOME T vs. M/S STERLING AGRO PRODUCTS
What did the High Court hold?
The High Court dismissed the appeals as withdrawn. The Court noted that the tax effect in these appeals was less than the threshold limit of Rs.1,00,00,000/- stipulated in CBDT Circular No.17/2019. Consequently, the appeals were dismissed based on this circular, with the substantial questions of law being kept open for determination in appropriate cases. No costs were awarded, and the connected miscellaneous petitions were closed. The judgment did not delve into the merits of the substantial questions of law raised, as the appeals were disposed of on a procedural ground related to the tax effect.
What were the facts?
The Commissioner of Income Tax, Chennai (appellant/Revenue) filed two Tax Case Appeals (T.C.A.Nos.364 and 365 of 2015) against the common order dated 26.08.2011 passed by the Income Tax Appellate Tribunal (ITAT), 'B' Bench, Chennai. These appeals pertained to assessment years 2006-07 and 2007-08 and challenged the ITAT's decision regarding the allowability of advances given to farmers that were written off by the assessee, M/s. Sterling Agro Products Processing Pvt. Ltd. The High Court admitted these appeals on substantial questions of law on 22.07.2015. Subsequently, during the hearing, the Revenue brought to the court's notice CBDT Circular No.17/2019, which stipulates that appeals shall not be filed or pursued if the tax effect does not exceed Rs.1,00,00,000/-.
What were the issues?
The High Court was called upon to decide the following substantial questions of law: 1. Whether, on the facts and circumstances of the case, the Tribunal was right in holding that the disallowance of advance given to farmers written off by the assessee is allowable, especially when no evidence was produced to show that debts had occurred during the earlier assessment year for writing off such sum advanced? 2. Whether, on the facts and in the circumstances of the case, the Tribunal was right in holding that the amounts advanced to farmers were to be written off, especially when the same had been shown in the accounts as selling and distribution expenses and no material was produced by the assessee to substantiate the said claim? The Revenue contended that the disallowance of advances written off should not be allowed without evidence of debt occurrence in earlier years and that the amounts shown as selling and distribution expenses lacked substantiation. The judgment does not record specific arguments from the assessee regarding these issues, nor does it mention any specific authorities, circulars, or precedents relied upon by either party during the initial admission of the appeals.
