What did the High Court hold?

The High Court did not decide the substantial questions of law framed for consideration. This was due to subsequent developments, specifically the enactment of the Direct Tax Vivad Se Vishwas Act, 2020. The learned Senior Standing Counsel for the appellant/Revenue submitted that the respondent/assessee had availed the Vivad Se Vishwas Scheme and had been issued Form-3. Consequently, since the assessee had opted for the scheme, nothing further remained for adjudication in the appeal. The appeal was disposed of on this basis, with no costs awarded. The specific findings of the ITAT on the bad debt claim and the application of Section 36(1)(vii) were not reviewed or overturned by the High Court.

What were the facts?

The Revenue, Commissioner of Income Tax, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 24.05.2019 passed by the Income Tax Appellate Tribunal (ITAT), Chennai "D" Bench, for the assessment year 2013-14. The appeal was admitted on substantial questions of law concerning the allowability of a bad debt claim by the assessee, M/s. Rattha Holding Company Pvt. Ltd. The ITAT had allowed the claim, which the Revenue challenged. During the pendency of the appeal before the High Court, the Direct Tax Vivad Se Vishwas Act, 2020, was enacted. The Revenue's counsel submitted that the assessee had availed the Vivad Se Vishwas Scheme and had been issued Form-3, indicating the dispute resolution process had commenced.

What were the issues?

The Tribunal had to decide three substantial questions of law: 1. Whether the Tribunal was correct in allowing the claim for bad debts when the amounts paid were in the nature of advances and not a debt initially, as per Section 36(1)(vii) of the Income Tax Act? 2. Whether the Tribunal's reasoning and finding in allowing the bad debt claim were proper, given that the assessee had not satisfied the conditions prescribed under Section 36(1)(vii) of the Income Tax Act? 3. Whether the Tribunal ought to have applied the ratio of the Apex Court decisions in A.V. Thomas and Co. Ltd. (48 ITR 67) and Indian Aluminium Co. Ltd. (79 ITR 514), which held that for a debt to become bad or doubtful, it must first be a debt? Contentions: Assessee: No arguments were recorded for the respondent/assessee as they made no appearance. Revenue: The Revenue contended that the amounts claimed as bad debts were advances, not debts, and that the conditions under Section 36(1)(vii) were not met. They relied on the Apex Court decisions in A.V. Thomas and Co. Ltd. and Indian Aluminium Co. Ltd.
