What did the High Court hold?

The High Court dismissed the appeals as withdrawn. The Court noted the submission made by the learned counsel for the appellant/Revenue regarding Circular No.17/2019 issued by the Central Board of Direct Taxes. This circular mandates that appeals shall not be filed or pursued by the Department before the High Court in cases where the tax effect does not exceed Rs.1,00,00,000/-. The Revenue confirmed that the tax effect in these appeals was less than the stipulated threshold limit. Consequently, in light of this submission and the circular, the appeals were dismissed as withdrawn. The Court explicitly stated that the substantial questions of law were kept open for determination in appropriate cases. No costs were awarded.

What were the facts?

The Commissioner of Income Tax, Chennai (Revenue) filed three tax case appeals (T.C.A.Nos.354, 357 & 358 of 2021) before the High Court of Judicature at Madras. These appeals challenged a common order dated 12.05.2017 passed by the Income Tax Appellate Tribunal (ITAT), "C" Bench, Chennai. The ITAT's order was in Miscellaneous Applications (MA.Nos.39, 42 and 40/Mds/2017) filed against original orders in I.T.A.Nos.1780, 1783 and 1781/Mds/2013. The assessment years involved were 2007-08, 2010-11, and 2008-09. The High Court admitted these appeals on substantial questions of law on 16.07.2021.

What were the issues?

The High Court had to decide the following substantial questions of law: 1. Whether the Tribunal was right in rectifying its order under section 254(2) dated 12.05.2017, which was passed beyond the 6-month time limit prescribed under section 254(2), especially when the original order dealt with merits and was passed on 04.03.2015? 2. Whether the Tribunal's finding was bad by entertaining three Miscellaneous Applications against the original order passed on 04.03.2016, which would amount to reviewing the original order, a power the Tribunal does not possess under the statute? The Revenue argued that the ITAT's rectification order was passed beyond the statutory time limit and that entertaining the miscellaneous applications amounted to an impermissible review of the original order. The Revenue relied on Circular No.17/2019 issued by the CBDT, which stipulates that appeals shall not be filed or pursued if the tax effect does not exceed Rs.1,00,00,000/-. The Revenue submitted that the tax effect in these appeals was less than this threshold limit. The judgment does not record specific arguments from the assessee.
