What did the High Court hold?

The High Court noted that the assessee had filed a declaration under the Vivad Se Vishwas Scheme on December 28, 2020. In light of this subsequent event, the Court directed the Competent Authority to process the application/declaration under the Direct Tax Vivad Se Vishwas Act, 2020, and pass appropriate orders expeditiously. The assessee was granted liberty to restore the appeal if the decision on their declaration was not in their favour. Consequently, the substantial questions of law framed by the Revenue were left open, and the Tax Case Appeal was disposed of without a decision on the merits of the case. No costs were awarded. The operative direction was to process the Vivad Se Vishwas application and allow restoration of the appeal if necessary.

What were the facts?

The Revenue, specifically the Principal Commissioner of Income Tax, Corporate Circle - 4(1), Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated June 12, 2017, passed by the Income Tax Appellate Tribunal, Madras 'B' Bench. The appeal pertains to assessment year 2012-13 and concerns the assessee, M/s. Lifecell International Pvt. Ltd. The dispute revolves around the tax treatment of storage fees collected by the assessee. The procedural history indicates that the Tribunal had previously decided the matter, and this appeal is the Revenue's challenge to that decision. The amount in dispute is not explicitly stated.

What were the issues?

The Tribunal was asked to decide three substantial questions of law: 1. Whether the storage fees collected by the assessee could be treated as income in the year of receipt (AY 2012-13). 2. Whether only a part of the storage fees accrued as income for the year, despite no liability to refund any portion as per the agreement. 3. Whether the Tribunal erred in deleting the addition contrary to Section 5(1) of the Income Tax Act. The Revenue argued that the ITAT was incorrect in its findings on these issues. The Assessee contended that it had filed a declaration under the Vivad Se Vishwas Scheme on December 28, 2020, and was awaiting orders. The judgment does not record specific arguments from the assessee regarding the merits of the case, other than their participation in the Vivad Se Vishwas Scheme.
