HARI PODDAR AND OTHERS vs. THE ASST COMMISSIONER OF
What did the High Court hold?
The High Court did not decide the substantial questions of law framed by the assessee. Instead, the Court was informed that the assessee had availed the benefit of the Direct Tax Vivad Se Vishwas Act, 2020. The assessee's counsel sought permission to withdraw the appeals, having been issued Form-3 under the said Act. Consequently, the High Court dismissed the appeals as withdrawn. No specific findings were made by the High Court on the merits of the issues raised by the assessee or the ITAT's order. The operative direction was to dismiss the appeals as withdrawn, with no costs. The connected miscellaneous petitions were also closed.
What were the facts?
The appeals were filed by the assessee, Hari Poddar & Others (L/H of Smt. Prathiba Poddar), against the order of the Income Tax Appellate Tribunal (ITAT), Chennai Bench, dated 24.05.2017. The appeals pertained to block assessment years 1997-98 to 2003-04 (up to 08.08.2002). The core of the dispute involved the validity of the block assessment order passed on 21.10.2004, specifically concerning whether it was within the time limit prescribed by Section 158BE(1)(b) of the Income Tax Act, 1961. The assessee argued that the last Panchanama was drawn on 08.08.2002, making the assessment order time-barred, while the Revenue contended it was drawn later. The appeals also raised issues regarding additions made to the assessee's income.
What were the issues?
The Tribunal had to decide several substantial questions of law. The primary issue concerned the legality and timeliness of the block assessment order. Specifically: 1. Whether the block assessment order dated 21.10.2004 was within the time limit prescribed by Explanation 2 to Section 158BE(1)(b) of the Income Tax Act, 1961, considering the last Panchanama was drawn on 08.08.2002 and not 01.10.2002. 2. Whether the Tribunal erred in following the judgment in VLS Finance Ltd. v. CIT, which the assessee argued was inapplicable. 3. Whether the block assessment was barred by limitation, given that only Panchanamas were prepared subsequently regarding prohibitory orders, not a subsequent search. 4. Whether the Panchanama drawn on 01.10.2002 (or 03.10.2002 for Hari Poddar) was to be treated as the last Panchanama, making the assessment order within two years. 5. Whether the Tribunal rightly held the last Panchanama was drawn on 01.10.2002 without deciding the legality of the search conclusion based on that Panchanama. 6. Whether the Tribunal was justified in sustaining additions of Rs.61.00 Lakhs (undisclosed bank account), Rs.10.27 Lakhs (unaccounted purchases), and Rs.22.55 Lakhs (profit from Vigneswara Traders). For TCA Nos. 347 and 348 of 2018, further issues included: 1. Whether Rs.10.27 Lakhs on account of unaccounted purchases could be treated as cash credit under Section 68, as the amounts were received for supply of goods. 2. Whether Rs.22.55 Lakhs profit from Vigneswara Traders was wrongly restored to the assessment, given that accounts were maintained regularly and advance tax was paid. 3. Whether Rs.1.25 Crores of unexplained cash credits could be treated as cash credits under Section 68, when recorded in regular books and received for supply of goods. 4. Whether the entire unexplained credit should be considered income under Section 68, without estimation of Gross Profit. Assessee's Contentions: The assessee argued that the assessment order was time-barred, that the VLS Finance Ltd. judgment was misapplied, and that certain additions were unjustified as they related to regular business transactions or were wrongly classified under Section 68. Revenue's Contentions: The revenue contended that the assessment order was within time, and the additions were correctly made. The judgment does not explicitly detail the revenue's arguments on each specific issue beyond their general stance.
