What did the High Court hold?

The High Court noted that during the pendency of the appeals, the assessee had availed the benefit of the Direct Tax Vivad Se Vishwas Act, 2020. The assessee had filed the requisite forms, which were accepted, and Form 3 was issued by the Income Tax Department. The Revenue conceded this development. Consequently, the High Court held that it was unnecessary to decide the substantial questions of law that had arisen in the appeals. The appeals were disposed of based on the submissions made by both sides, with a direction to the department to process the applications under the Vivad Se Vishwas Act at the earliest and communicate the decision to the assessee. No costs were awarded.

What were the facts?

The assessee, T.V. Sundram Iyengar & Sons Ltd, filed two appeals (TCA Nos. 331 and 800 of 2015) before the High Court of Judicature at Madras. These appeals challenged orders of the Income Tax Appellate Tribunal, Madras ('the Tribunal') for the assessment year 2006-07. TCA No. 331 of 2015 challenged the Tribunal's order dated 26.09.2014 in ITA No. 687/Chny/2014, and TCA No. 800 of 2015 challenged the Tribunal's order dated 04.03.2015 in M.P. 1//Chn/2015 in ITA No. 687/2014. The appeals were admitted on substantial questions of law.

What were the issues?

The High Court was to decide the following substantial questions of law: 1. Whether the Tribunal was justified in confirming the reassessment for invoking Section 50C of the Income Tax Act, 1961. 2. Whether the Tribunal was right in upholding the reassessment based on an audit objection and ignoring the Supreme Court's decision in Indian & Eastern Newspaper Society v. CIT. 3. Whether the Tribunal was right in confirming the reassessment for applying Section 50C based on the Collector's valuation report, without addressing grounds three and four raised by the assessee. 4. Whether the Tribunal was justified in not dealing with the facts presented in the assessee's miscellaneous petition and holding it to be a review of the Tribunal's order. Assessee's Contentions: The assessee's counsel submitted that the assessee had filed Forms 1 and 2 under Section 4(1) of the Direct Tax Vivad Se Vishwas Act, 2020, which were accepted, and Form 3 was issued on 18.03.2021. A memo with a copy of Form 3 was filed. Revenue's Contentions: The learned junior standing counsel for the Revenue fairly conceded the submissions made by the assessee's counsel.
