SHRI.S. KOTHANDAN vs. THE ASSISTANT COMMISSIONER O
What did the High Court hold?
The High Court noted that the assessee had filed a declaration under the Vivad Se Vishwas Scheme on March 8, 2021, and was awaiting orders. In light of this subsequent event, the Court directed the Competent Authority to process the application/declaration under the Direct Tax Vivad Se Vishwas Act, 2020, and pass appropriate orders expeditiously. The assessee was granted liberty to restore the appeal if the decision on their declaration was not in their favour. Consequently, the substantial questions of law raised in the appeal were left open and not decided on merits. The tax case appeal was disposed of with the aforementioned liberty.
What were the facts?
The assessee, Shri. S. Kothandan, filed an appeal before the High Court of Judicature at Madras under Section 260A of the Income Tax Act, 1961. The appeal challenged an order dated September 9, 2016, passed by the Income Tax Appellate Tribunal, Chennai 'A' Bench, in I.T.A.No.2276/Mds/2015 concerning the assessment year 2012-13. The dispute pertains to additions made to the assessee's income as cash credits. The procedural history involves the assessee filing a declaration under the Vivad Se Vishwas Scheme on March 8, 2021, and awaiting orders.
What were the issues?
The Tribunal was to decide the following substantial questions of law: 1. Whether Section 68 of the Income Tax Act, 1961, permits the assessment of cash credits as undisclosed income despite the assessee discharging the initial burden of proving the genuineness of the transaction. 2. Whether Section 68 of the Act envisages cash credit additions when an enquiry report indicates the source of the loan amounts received by the assessee. 3. Whether the Appellate Tribunal correctly sustained cash credit additions overlooking a gross violation of the principles of natural justice. 4. Whether the Appellate Tribunal correctly interpreted Section 68 of the Act to sustain cash credit additions in the computation of taxable total income for assessment year 2012-13. The assessee contended that they had filed a declaration under the Vivad Se Vishwas Scheme. The revenue did not present any arguments as the matter was disposed of due to the subsequent event.
