M/S.NIPPON PAINT (INDIA) PVT vs. THE DEPUTY COMMISSIONER OF I
What did the High Court hold?
The High Court disposed of the Tax Case Appeal in light of the subsequent event of the assessee filing a declaration under the Vivad Se Vishwas Scheme, 2020. The Court directed the Competent Authority to process the application/declaration expeditiously and pass appropriate orders. The assessee was granted liberty to restore the appeal if the ultimate decision on their declaration was not in their favour. In such an event, the Registry was directed to entertain the restoration petition without insisting on a condonation of delay application. Consequently, the substantial questions of law framed for the appeal were left open and not decided on merits. No costs were awarded.
What were the facts?
The assessee, M/s. Nippon Paint (India) Pvt Ltd., filed an appeal before the High Court of Judicature at Madras under Section 260A of the Income Tax Act, 1961. The appeal challenged an order dated 29.03.2019 passed by the Income Tax Appellate Tribunal, Madras 'D' Bench, for the assessment year 2010-11. The Revenue was represented by the Deputy Commissioner of Income Tax, International Taxation 2(2), Chennai. The appeal was admitted on substantial questions of law concerning whether amounts paid to seconded employees and reimbursement of expenses constituted fees for technical services.
What were the issues?
The Tribunal had to decide two substantial questions of law: 1. Whether, under the facts and circumstances of the case, the Tribunal was right in holding amounts paid to seconded employees as Fee for technical services? This question turns on the interpretation of provisions related to fees for technical services under the Income Tax Act, 1961, and potentially the Double Taxation Avoidance Agreement (DTAA) if applicable. 2. Whether, under the facts and circumstances of the case, the Tribunal was right in holding reimbursement of expenses as fees for technical services? This question also relates to the characterization of payments as fees for technical services. The assessee's counsel submitted that the assessee had filed a declaration/undertaking under the Vivad Se Vishwas Scheme on 31.01.2021 and was awaiting orders. The Revenue did not present any arguments on the merits of the case, as the appeal was disposed of due to the subsequent event of the Vivad Se Vishwas Scheme application.
