PRINCIPAL COMMISSIONER OF IN vs. M/S.SRI MUTHUKUMARAN EDUCATI
What did the High Court hold?
The High Court noted that during the pendency of the appeal, the assessee had availed the benefit of the Direct Tax Vivad Se Vishwas Act, 2020, and had filed declarations which were accepted, leading to an order for full and final settlement of tax arrears on 22.01.2021. The learned counsel for the appellant/Revenue submitted this fact, which was fairly conceded by the learned counsel for the respondent/assessee. In view of this subsequent development, the High Court was of the opinion that nothing survived for adjudication in the appeal. The appeal was disposed of based on the submissions made by the counsel on either side, without deciding the substantial questions of law on merits. No costs were awarded.
What were the facts?
The Revenue, Principal Commissioner of Income Tax-I, filed a Tax Case Appeal under Section 260A of the Income Tax Act, 1961, against the order dated 21.01.2020 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'B' Bench, in I.T.A.No.831 of 2019. The appeal pertains to the Assessment Year 2012-2013. The High Court admitted the appeal on substantial questions of law. During the pendency of the appeal, the assessee, M/s. Sri Muthukumaran Educational Trust, availed the benefit of the Direct Tax Vivad Se Vishwas Act, 2020, filed necessary declarations, and received an order for full and final settlement of tax arrears on 22.01.2021. This development was conceded by both parties.
What were the issues?
The High Court admitted the appeal on five substantial questions of law: 1. Whether the ITAT's direction to remit issues back to the Assessing Officer (AO) was perverse? 2. Whether the ITAT was correct in remitting issues without considering the AO's finding that donors examined under Section 131 were bogus and denied giving donations? 3. Whether the ITAT was correct in holding that it was unknown whether donations were from students or related parties, despite the AO's verification showing alleged donors were impoverished and lacked means to pay donations? 4. Whether the ITAT was correct in ignoring the AO's finding that the assessee Trust did not have corresponding entries for 'Salary Advance', 'Festival Advance', and 'Medical Advance'? 5. Whether the ITAT was correct in holding that fees were collected only from students as prescribed by the High Level Committee, when the AO had established the collection of anonymous donations without establishing donor identity? The Revenue argued that the ITAT's order was perverse and that the AO had established the bogus nature of donors and the lack of proper accounting for advances. The assessee's contentions are not explicitly recorded, beyond their concession regarding the Vivad Se Vishwas Act.
