THE COMMISSIONER OF INCOME T vs. SMT. R.MAHALAKSHMI
What did the High Court hold?
The High Court noted that the assessee had filed a declaration under the Vivad Se Vishwas Scheme, 2020, on July 17, 2020, and was awaiting orders. Consequently, the Court directed the Competent Authority to process the declaration under the Direct Tax Vivad Se Vishwas Act, 2020, and pass appropriate orders expeditiously. The assessee was granted liberty to restore the appeals if the decision on their declaration was not in their favour. In such an event, the Registry was directed to entertain restoration petitions without insisting on condonation of delay. The substantial questions of law were left open, and the appeals were disposed of with the aforementioned liberty.
What were the facts?
The Revenue, Commissioner of Income Tax, Chennai, filed two appeals (TCA.Nos.3 & 6 of 2021) before the High Court of Judicature at Madras. These appeals challenged a common order dated 25.11.2016 passed by the Income Tax Appellate Tribunal, Chennai ('the Tribunal'), in ITA Nos. 986 and 1305/Mds/2013 concerning the assessment year 2008-09. The appeals were filed under Section 260A of the Income Tax Act, 1961. The core of the dispute revolved around the deletion of a penalty levied under Section 271(1)(c) of the Act by the Tribunal.
What were the issues?
The Tribunal had to decide the following substantial questions of law: 1. Whether, on the facts and in the circumstances of the case, the Tribunal was right in deleting the penalty levied under Section 271(1)(c) of the Income Tax Act? 2. Whether the reasoning and finding of the Tribunal is correct by deleting the penalty under Section 271(1)(c) even without discussion on the said point? An additional question in TCA.No.6 of 2021 was: Is not the finding of the Tribunal bad after holding that the penalty proceedings are applicable under Section 271(1)(c) and not under Section 271AA and thereafter dismissing the departmental appeal as infructuous? The Revenue argued that the Tribunal erred in deleting the penalty under Section 271(1)(c). The assessee's counsel submitted that the assessee had filed a declaration under the Vivad Se Vishwas Scheme on 17.7.2020 and was awaiting orders.
