COMMISSIONER OF INCOME TAX vs. M/S.CRI PUMPS PVT LTD
What did the High Court hold?
The High Court noted that during the pendency of the appeals, the assessee had successfully availed the benefits of the Direct Tax Vivad Se Vishwas Act, 2020. The assessee had filed the requisite forms (Forms 1 and 2), which were accepted by the Income Tax Department, and Form 3 was issued to the assessee. The Revenue's counsel fairly conceded this development. In light of the assessee having resolved the disputed tax under the beneficial legislation, the High Court deemed it unnecessary to decide the substantial questions of law that had arisen in these appeals. The appeals were disposed of based on the submissions made by both sides, with a direction to the department to process the applications at the earliest in accordance with the Act and communicate the decision to the assessee. No costs were awarded.
What were the facts?
The Revenue filed three Tax Case Appeals (TCA Nos. 1196 & 1197 of 2015 and 292 of 2016) before the High Court of Judicature at Madras, challenging orders of the Income Tax Appellate Tribunal (ITAT) dated 05.03.2015 and 12.08.2015. These orders pertained to Assessment Years 2008-09, 2009-10, and 2010-11. The appeals were admitted on substantial questions of law concerning the cancellation of penalties levied under Section 271(1)(c) of the Income Tax Act, 1961, by the ITAT. During the pendency of these appeals, the assessee, M/s. CRI Pumps Pvt. Ltd., availed the benefit of the Direct Tax Vivad Se Vishwas Act, 2020, by filing requisite forms, which were accepted by the Income Tax Department, and Form 3 was issued.
What were the issues?
The High Court had to decide the following substantial questions of law: 1. Whether the Appellate Tribunal was right in cancelling the penalty levied under Section 271(1)(c) of the Income Tax Act, 1961, when the assessee furnished inaccurate particulars and claimed additional depreciation on plant and machinery acquired and installed relating to earlier assessment years? 2. Whether the Appellate Tribunal was right in cancelling the penalty levied under Section 271(1)(c) when it had confirmed the deletion of additional depreciation claimed by the assessee in its quantum order? 3. Whether the Appellate Tribunal was right in cancelling the penalty levied under Section 271(1)(c) by relying on the judgment of the Hon'ble Supreme Court of India in the case of Reliance Petroproducts Pvt. Ltd. [(2010) 322 ITR 158]? Contentions: Assessee: Submitted that the assessee has availed the benefit of the Direct Tax Vivad Se Vishwas Act, 2020, by filing the necessary forms, which were accepted, and Form 3 was issued. Therefore, the appeals have become infructuous. Revenue: Fairly conceded the submission made by the assessee's counsel regarding the availing of the Direct Tax Vivad Se Vishwas Act, 2020.
