What did the High Court hold?

The High Court decided not to adjudicate the substantial questions of law due to the enactment of the Direct Tax Vivad Se Vishwas Act, 2020. The court was informed that the assessee had availed the benefit under this Act and was issued Form-3. Consequently, the appeals were dismissed as no useful purpose would be served by keeping them pending. The court granted liberty to the assessee to restore the appeals if the ultimate decision under the Vivad Se Vishwas Act was not in their favour. In such an event, the Registry was directed to entertain a Miscellaneous Petition for Restoration without insisting on a delay condonation application. The substantial questions of law were left open.

What were the facts?

The assessee, A. Sundaram, filed five Tax Case Appeals (TCAs) against the order of the Income Tax Appellate Tribunal (ITAT), Madras 'C' Bench, dated 15.05.2015. These appeals pertained to assessment years 2001-02 to 2005-06. The appeals were admitted on substantial questions of law. During the pendency of these appeals before the High Court, the Direct Tax Vivad Se Vishwas Act, 2020, was enacted. The assessee informed the court that they had been issued Form-3 under this Act, indicating they had availed the benefit of the scheme. Consequently, the High Court found no useful purpose in keeping the appeals pending.

What were the issues?

The High Court was to decide four substantial questions of law concerning the assessment of credits in the current account of LVB. 1. Whether the ITAT was justified in confirming the addition of credits in the current account of LVB as 'individual' instead of assessing them in the status of HUF, given a registered partition in 1954? 2. Whether the ITAT was justified in confirming the addition without ruling on evidence presented for a textile business carried on by the HUF of Arthanari since 1971? 3. Whether the ITAT ought to have deleted the addition of bank balances, holding them assessable only in the hands of the HUF of Arthanari, in light of the Supreme Court decision in 73 ITR 539? 4. Whether the ITAT was justified in not deleting the addition, considering the LVB current account balance was returned in the HUF assessment, leading to double taxation? Assessee's Contentions: The assessee argued that the credits should be assessed as HUF based on a 1954 partition and evidence of an HUF textile business since 1971. They also contended that the addition should be deleted as it was assessable only in the hands of the HUF of Arthanari and that confirming the addition would lead to double taxation, citing Supreme Court decision in 73 ITR 539. Revenue's Contentions: The judgment does not record specific contentions from the revenue for each question.

We have heard Mr.T.Vasudevan, learned counsel for the appellant/assessee and Mrs.V.Pushpa, learned Senior Standing Counsel for the respondent/Revenue. 4. It may not be necessary for this Court to decide the Substantial Questions of Law framed for consideration on account of certain subsequent developments. The Act of the Parliament received the assent of the President on 17th March 2020 and published in the Gazette of India on 17th March 2020. 5.We are informed by the learned counsel for the appellant/ assessee that the assessee has already been issued with Form – 3 on 16.12.2020 in all the above appeals. 6. In the light of the fact that the assessee has already availed the benefit under the Act, no useful purpose would be served in keeping these appeals pending. At the same time, safeguarding the interest of the assessee in the event the order to be passed by the Department under the Act is not in favour of the assessee. Accordingly, the Tax Case Appeal is dismissed on the ground that the assessee has already been issued with Form - 3 in all the above appeals and the Department shall process the applications at the earliest in accordance with the said Act and communicate the decision to the assessee at the earliest. As observed, the Page 4/6 http://www.judis.nic.in Tax Case Nos.284 to 288 of 2016 assessee is given liberty to restore these appeals in the event the ultimate decision to be taken on the declaration filed by the assessee under Section 4 of the said Act is not in favour of the assessee.
