What did the High Court hold?

The High Court noted the submission by the Revenue's counsel that the main appeal had already been disposed of by the ITAT. Consequently, the appeal filed against the interim order in that main appeal was rendered redundant. Therefore, the Tax Case Appeal was dismissed as infructuous. The Court explicitly stated that the substantial questions of law raised in the appeal were left open and would be decided in an appropriate future appeal. No costs were awarded. The specific findings on the merits of the questions of law regarding the ITAT's power to grant stay under Section 254(2A) were not decided.

What were the facts?

The Commissioner of Income Tax, Chennai (Revenue) filed an appeal under Section 260A of the Income Tax Act, 1961, against an order of the Income Tax Appellate Tribunal (ITAT), Madras "B" Bench, dated 27.02.2015. This order was passed in S.P.No.122/Mds/2015 in I.T.A.No.2353/Mds/2012, pertaining to the Assessment Year 2008-09. The appeal was admitted on substantial questions of law concerning the ITAT's power to grant a stay of recovery of tax. During the hearing, the Revenue's counsel submitted that the main appeal (I.T.A.No.2353/Mds/2012) had subsequently been disposed of by the ITAT on 22.04.2016. Consequently, the present appeal, filed against an interim order in the main appeal, had become redundant.

What were the issues?

The Tribunal had to decide the following substantial questions of law: 1. Whether the Tribunal was right in holding that the assessee had co-operated in the appeal proceedings and granted a stay of recovery of tax for a further period of 120 days or until the pronouncement of the order, whichever is earlier, which is contrary to the statutory provisions of Section 254(2A) of the Income Tax Act? 2. Is not the finding of the Tribunal bad by granting a stay for a further period of 120 days or until the disposal of the appeal, which is contrary to the statutory provision enacted and against the intention of the legislature? Contentions: Assessee: No arguments are recorded for the assessee in the provided judgment. Revenue: The Revenue contended that the appeal filed against the interim order had become redundant because the main appeal (I.T.A.No.2353/Mds/2012) had already been disposed of by the ITAT by an order dated 22.04.2016.
