What did the High Court hold?

The High Court dismissed the appeal preferred by the Revenue against the order of the Income Tax Appellate Tribunal. The dismissal was based on the submission by the Revenue that the appeal was not being pursued due to a low tax effect, as per Circular No. 17/2019 of the Central Board of Direct Taxes. This circular increased the monetary limit for filing or pursuing appeals before the High Court to Rs. 1 Crore, and the tax effect in the present case was below this limit. Consequently, the substantial question of law framed at the time of admission of the appeal was left open. The Revenue was granted liberty to mention the case for restoration if the tax effect was found to be above the threshold limit in the future. No costs were awarded.

What were the facts?

The Revenue, Commissioner of Income Tax, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order of the Income Tax Appellate Tribunal, Chennai, dated October 1, 2013. This order pertained to the Assessment Year 1998-99 and was passed in ITA No. 39/Mds/2013. The appeal was admitted by the High Court on June 22, 2015, based on a substantial question of law concerning the applicability of clause (c) of Explanation to Section 115JA to a Site Restoration fund/expenses when determining book profit. The assessee is M/s. Cairn Energy India P Ltd.

What were the issues?

1. Is the finding of the Tribunal bad in law, especially when clause (c) of Explanation to Section 115JA applies in the case of Site Restoration fund/expenses while determining the book profit? (Question of law) The Revenue argued that the appeal was not being pursued due to low tax effect, citing Circular No. 17/2019 of the CBDT, which increased the monetary limit for appeals to the High Court to Rs. 1 Crore. The tax effect in this case was stated to be below this threshold. The Assessee's contentions were not recorded as the appeal was dismissed on the grounds of low tax effect.
