THE COMMISSIONER OF INCOME T vs. SHRI N.K.MOHNOT
What did the High Court hold?
The High Court dismissed the appeals filed by the Revenue. The dismissal was based on the Revenue's submission regarding the low tax effect, as per CBDT Circular No.17/2019. The Court noted that the monetary limit for filing or pursuing appeals before the High Court had been increased to Rs.1 Crore by the circular, and the tax effect in the respective cases was below this limit. Consequently, the appeals were dismissed on this ground. The substantial question of law raised by the Revenue was expressly left undecided. The Court granted liberty to the Revenue to file a petition to restore the appeals if the tax effect was found to be above the threshold limit in the future. The connected Civil Miscellaneous Petition (CMP) was also closed.
What were the facts?
The Commissioner of Income Tax, Chennai, filed two Tax Case Appeals (TCA.Nos.255 & 256 of 2021) before the High Court of Judicature at Madras. These appeals challenged a common order dated 17.3.2017 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'A' Bench, in WTA.Nos.21 and 20/Mds/2016. The appeals pertained to wealth tax assessments for assessment years 1983-84 and 1984-85. The core of the dispute involved the ITAT's decision to remit wealth tax additions back to the Assessing Officer, contingent on the deletion of similar additions in the corresponding income tax assessments. The Revenue sought to appeal this remittal order.
What were the issues?
1. Whether, on the facts and in the circumstances of the case, the Tribunal was right in remitting back the issue of additions made under the wealth tax assessment for assessment years 1983-84 and 1984-85 to the Assessing Officer with a direction to delete such additions if the Assessing Officer finds that similar additions were deleted by the Tribunal in its common order pertaining to income tax assessment, despite the fact that the issue had not attained finality as tax case appeals had been filed before the High Court of Madras. Assessee's Contentions: The judgment does not record any specific contentions made by the assessee (Shri.N.K.Mohnot) in response to the Revenue's appeal. The appeal was disposed of based on the Revenue's submission. Revenue's Contentions: The Revenue submitted that the appeals were not being pursued due to low tax effect, citing CBDT Circular No.17/2019 which increased the monetary limit for filing or pursuing appeals before the High Court to Rs.1 Crore. The tax effect in these cases was stated to be below this threshold.

The Revenue has filed these appeals by raising the following substantial question of law : “Whether on the facts and in the circumstances of the case, the Tribunal was right in remitting back the issue of additions made under the wealth tax assessment for the assessment years 1983-84 and 1984-85 to the file of the Assessing Officer with a direction to delete such additions made if the Assessing Officer finds that in the Tribunal's common order pertaining to income tax assessment were deleted by the Tribunal as the additions 2/4 https://www.mhc.tn.gov.in/judis/ TCA.Nos.255 & 256 of 2021 made in the wealth tax assessments were deleted by the Tribunal forgetting the fact that the issue had not attained finality as tax case (appeals) had been filed before the High Court of Madras?” 4. By the said Circular, the monetary limit for filing or pursuing an appeal before the High Court has been increased to Rs.1 Crore. It is further submitted that the tax effect in the respective cases is less than the threshold limit. 5. In the light of the said submissions, the above tax case appeals are dismissed on account of the low tax effect. The substantial question of law raised is left open. In the event the tax effect in the respective cases is above the threshold limit fixed in the said circular, liberty is granted to the Revenue to file a petition before this Court to restore the appeals to be heard and decided on merits.
