What did the High Court hold?

The High Court did not decide the substantial questions of law. It was informed that the Direct Tax Vivad Se Vishwas Act, 2020, had been enacted. The assessee's counsel stated that Form-3 had been issued to the assessee under the Act and sought permission to withdraw the appeals. The Court noted that no useful purpose would be served by keeping the appeals pending, but safeguarded the assessee's interest in case the decision under the Vivad Se Vishwas Act was not in their favour. Consequently, the Tax Case Appeals were dismissed as withdrawn, with liberty granted to the assessee to restore the appeals if the ultimate decision on their declaration under Section 4 of the Act was not in their favour. The substantial questions of law were left open.

What were the facts?

The assessee, M/s.M.Ct.M.Global Investments Private Limited, filed appeals before the High Court of Judicature at Madras against the order dated 21.10.2016 passed by the Income Tax Appellate Tribunal, Chennai "A" Bench. These appeals, Tax Case Appeal Nos. 253 to 255 of 2017, were filed under Section 260A of the Income Tax Act, 1961, challenging the Tribunal's decision concerning assessment years 2006-07, 2007-08, and 2008-09. The appeals were directed against the orders in C.O.No.200/Mds/2019 in I.T.A.No.1654/Mds/2009, I.T.A.Nos.1102/Mds/2011, and 115/Mds/2012. The Revenue was represented by the Asst. Commissioner of Income Tax, Company Circle IV(1), Chennai.

What were the issues?

The High Court was to decide substantial questions of law framed by the appellant/assessee concerning the taxability of income earned by the Malaysian Branch in India, the classification of interest income as business income versus income from other sources for a non-banking financial company, the taxability of dividend income under "income from Other Sources" versus "income from business," and the classification of income/loss on purchase and sale of stock-in-trade as capital gains. The assessee also questioned the rejection of its claim that Malaysian income constituted business income. For TCA Nos. 254 and 255 of 2017, additional questions included whether expenditure incurred by the Malaysian Branch was allowable if its income was taxable in India, and whether expenditure for earning income should be allowed under Section 37 or Section 56. The assessee argued that income derived in Malaysia constituted business income due to systematic and continuous business of purchase/sale of investments. The Revenue's contentions are not explicitly recorded in the provided text.
