D.JAYARAMAN vs. THE ASSISTANT COMMISSIONER O
What did the High Court hold?
The High Court noted that the assessee had filed a declaration/undertaking under the Vivad Se Vishwas Scheme, 2020. In light of this subsequent event, the Court directed the Competent Authority to process the application under the Direct Tax Vivad Se Vishwas Act, 2020, and pass appropriate orders expeditiously. The assessee was granted liberty to restore the appeal if the decision on their declaration under the Act was not in their favour. If such a prayer was made, the Registry was instructed to entertain the restoration petition without insisting on a condonation of delay application. Consequently, the substantial questions of law framed in the appeal were left open, and no decision was rendered on the merits of the case. The appeal was disposed of with the aforementioned liberty.
What were the facts?
The assessee, Mr. D. Jayaraman, filed an appeal before the Madras High Court under Section 260A of the Income Tax Act, 1961, challenging an order dated 02.07.2019 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'D' Bench. The appeal pertained to assessment year 2009-10. The core dispute revolved around the denial of exemption under Section 54F of the Act. The assessee contended that he possessed only one residential property at the time of purchasing the impugned property for which exemption was sought. The revenue, represented by the Assistant Commissioner of Income Tax, Circle - 1, Chennai, was the respondent. The procedural history indicates that the assessee had filed a declaration/undertaking under the Vivad Se Vishwas Scheme, and was awaiting orders.
What were the issues?
1. Whether, on the facts and in the circumstances of the case, the Tribunal was right in law in denying the exemption available to the Appellant u/s.54F of the Income Tax Act, especially when the Appellant was able to prove that he was in possession of only one residential property at the time of purchasing the impugned property for which the exemption is sought for? (Question of law/mixed law and fact, turning on Section 54F). Assessee's contention: The assessee argued that he was in possession of only one residential property at the time of purchasing the impugned property, which should entitle him to the exemption under Section 54F. Revenue's contention: The judgment records no specific contention for the revenue on this issue. 2. Whether, on the facts and in the circumstances of the case, the Tribunal was right in law in observing that properties referred as Property No.4 and 5 in Table No.1 is residential in nature especially when the Appellant have disposed of the same and has offered it for tax under the head "Income from Profits and gains of business?" (Question of law/mixed law and fact, turning on the nature of properties and their tax treatment). Assessee's contention: The assessee contended that properties No.4 and 5 were disposed of and offered for tax under 'Income from Profits and gains of business', implying they were not residential in nature for the purpose of the exemption claim. Revenue's contention: The judgment records no specific contention for the revenue on this issue.
