THE COMMISSIONER OF INCOME vs. M/S.INER AIA
What did the High Court hold?
The High Court noted that the Direct Tax Vivad Se Vishwas Act, 2020, had been enacted for the resolution of disputed tax. Since the assessee had availed the benefit under this Act and the Department had issued Form-3, the Court found no useful purpose in keeping the appeal pending. The appeal was disposed of on the ground that the assessee had availed the Vivad Se Vishwas Scheme. The Court granted liberty to the assessee to restore the appeal if the ultimate decision under the Vivad Se Vishwas Act was not in their favour. The substantial questions of law were left undecided. The Department was directed to process the application under the Act at the earliest and communicate the decision to the assessee.
What were the facts?
The Commissioner of Income Tax, Chennai (appellant/Revenue) filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 10.07.2015 passed by the Income Tax Appellate Tribunal, Madras "SMC" Bench, for the assessment year 2006-07. The appeal was admitted on substantial questions of law concerning the Tribunal's dismissal of the departmental appeal on grounds of low tax effect, exceptions to CBDT monetary limits, and the propriety of disallowance under Section 40(a)(ia). The respondent/assessee, M/s. Iner Aia, had availed the Direct Tax Vivad Se Vishwas Act, 2020, and the Department had issued Form-3 on 05.12.2020.
What were the issues?
1. Whether the Tribunal was right in dismissing the departmental appeal on the ground of low tax effect without considering the merits, especially when there was a revenue audit objection accepted by the Department? 2. Whether the Tribunal's order was proper, considering the case falls under exceptions in para 8(c) of the CBDT Notification dated 10.07.2014 regarding monetary limits? 3. Whether the Tribunal was correct in holding that the disallowance made under Section 40(a)(ia) was not proper? 4. Whether the Tribunal's reasoning was proper in holding that disallowance under Section 40(a)(ia) should only be on outstanding amounts and not on amounts already paid? 5. Whether the term 'payable' in Section 40(a)(ia) includes amounts already paid? Assessee's Contentions: The assessee submitted that they had availed the Vivad Se Vishwas Scheme, and the Department had issued Form-3. Revenue's Contentions: The Revenue argued that the Tribunal was wrong in dismissing the appeal on low tax effect and that the case fell under exceptions to monetary limits. They also contested the Tribunal's findings on disallowance under Section 40(a)(ia).
