What did the High Court hold?

The High Court dismissed the appeal filed by the Revenue. The dismissal was based on the submission by the Revenue's counsel that the appeal was not being pursued due to a low tax effect, as per CBDT Circular No. 17/2019, which increased the monetary limit for filing appeals before the High Court to Rs. 1 Crore. The Court noted that the tax effect in this case was below the threshold limit. Consequently, the substantial questions of law raised by the Revenue were left open. The Revenue was granted liberty to mention the case for restoration if the tax effect was found to be above the threshold limit. No costs were imposed.

What were the facts?

The Revenue, represented by the Principal Commissioner of Income Tax-4, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 28.10.2016 passed by the Income Tax Appellate Tribunal (ITAT), Madras 'D' Bench. The appeal pertained to the assessment year 2009-10 and concerned the assessee, M/s. Neovia Logistics Services India Pvt. Ltd. The dispute revolved around the deduction claimed by the assessee under Section 10A of the Income Tax Act. The Revenue's appeal was filed challenging the ITAT's decision to grant this deduction.

What were the issues?

The Tribunal had to decide three substantial questions of law: 1. Whether the Tribunal was correct in granting deduction under Section 10A when there was a clear violation of Section 10A(2)(ii) of the Income Tax Act? 2. Whether the Tribunal was justified in holding that the assessee is entitled to deduction under Section 10A for the Logistics Division formed by splitting up or reconstruction of an already existing business? 3. Whether the Tribunal erred in disregarding the fact that the ultimate ownership of the Logistics Division vests with M/s. Caterpillar Inc., USA, which reconstructed its business by transferring this Division from CCPL to the assessee, rendering the order perverse? The Revenue argued that the conditions of Section 10A(2)(ii) were violated and that the Logistics Division was formed by splitting up an existing business. The Revenue also contended that the ultimate ownership remained with Caterpillar Inc., USA. The judgment does not record specific arguments made by the assessee on these points.

Which sections of the Income-tax Act were involved?
