What did the High Court hold?

The High Court held that the issue raised in the appeal was covered by a common judgment dated 18.12.2020 in TCA.Nos.432, 433 and 436 of 2020, to which one of the judges was a party. In light of this prior judgment, the Tax Case Appeal filed by the Revenue was dismissed. The High Court confirmed the impugned order passed by the ITAT. The reasoning behind this dismissal is that the specific substantial questions of law raised by the Revenue were already decided in the aforementioned common judgment. Therefore, the High Court did not independently analyze the merits of the questions regarding the delay in filing the e-appeal, the applicability of Rule 45, or the condonation of delay. The operative direction was to dismiss the appeal, thereby upholding the ITAT's order.

What were the facts?

The Revenue, Commissioner of Income Tax, Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 31.10.2019 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'C' Bench. The appeal pertains to the assessment year 2013-14. The core of the dispute revolves around the ITAT's decision regarding the filing of an e-appeal by the assessee, M/s. Saraf Housing Development P. Ltd., Chennai. The Revenue contended that the ITAT erred in its findings concerning the delay in filing the e-appeal and its subsequent condonation.

What were the issues?

The Tribunal had to decide the following substantial questions of law: 1. Whether, on the facts and in the circumstances of the case, the Tribunal was right in holding that there is no delay in filing of e-appeal by the assessee to the CIT(A) and remitting the case back for disposal on merits, thereby condoning the delay even though no e-appeal was filed by the assessee? 2. Whether, on the facts and in the circumstances of the case, the Tribunal was right in holding that there is no delay in filing of e-appeal since the date of filing of belated e-appeal relates back to the date of filing of manual appeal? 3. Whether, on the facts and in the circumstances of the case, the Tribunal was right in ignoring Rule 45 of the IT Rules mandating filing of e-appeal with effect from 01.03.2016 and the Board circular extending the time for filing of e-appeal only till 15.06.2016, thereby condoning the delay in filing of appeal before the CIT(A)? 4. Whether, on the facts and in the circumstances of the case, the Tribunal was right in condoning the delay in filing of appeal even though the assessee had failed to file any petition for condonation of delay before the CIT(A)? The Revenue argued that the Tribunal erred in condoning the delay in filing the e-appeal, particularly questioning the Tribunal's finding of no delay, the relation back to a manual appeal, the disregard for Rule 45 of the IT Rules and the Board circular, and the condonation of delay without a formal petition from the assessee. The assessee's arguments are not recorded in the judgment.
