THE COMMISSIONER OF INCOME T vs. M/S.BAY CONTAINER TERMINAL P
What did the High Court hold?
The High Court dismissed the appeals filed by the Revenue. The dismissal was based on the submission by the Revenue's counsel that the appeals were not being pursued due to a low tax effect, falling below the threshold limit of Rs. 1 Crore as per CBDT Circular No. 17/2019. Consequently, the substantial questions of law raised by the Revenue were left undecided. The Court granted liberty to the Revenue to seek restoration of the appeals if the tax effect was found to be above the threshold limit, allowing them to be heard and decided on merits. No costs were awarded. The connected civil miscellaneous petition was also dismissed.
What were the facts?
The Commissioner of Income Tax, Chennai (Revenue) filed two appeals before the High Court of Judicature at Madras against the common order dated 04.03.2019 passed by the Income Tax Appellate Tribunal, Chennai 'A' Bench. These appeals pertained to assessment years 2012-13 and 2011-12, and challenged the Tribunal's decision to allow plot maintenance and development expenses as revenue expenditure. The assessee is M/s. Bay Container Terminal Pvt. Ltd., Chennai. The appeals were filed under Section 260A of the Income Tax Act, 1961.
What were the issues?
The Tribunal had to decide the following substantial questions of law raised by the Revenue: 1. Whether plot maintenance and development expenses, incurred periodically and providing enduring benefit, should be treated as capital expenditure. 2. Whether these expenses should be allowed as revenue expenditure when the leased plot was not stock-in-trade. 3. Whether development charges paid in addition to lease amounts to the landlord, which would otherwise be incurred by the assessee for land development, constitute capital expenditure. 4. Whether the Tribunal's finding is bad if the expenses are capital in nature, and only depreciation should be granted. The Revenue argued that the expenses provided an enduring benefit and should be capital expenditure. The assessee's arguments are not explicitly recorded, but the Tribunal's decision implies they contended for revenue expenditure treatment. The Revenue relied on CBDT Circular No. 17/2019 regarding low tax effect.
