COMMISSIOONER OF INCOME TAX vs. SHRI KISHORE C.NANWANI,
What did the High Court hold?
The High Court did not decide the substantial questions of law on merits. Instead, the appeal was dismissed as withdrawn by the Revenue. This decision was based on the submission by the Revenue's counsel that the tax effect in the appeal was less than the monetary limit of Rs. 1,00,00,000/- stipulated in CBDT Circular No. 17/2019 for pursuing appeals before the High Court. The court explicitly stated that the substantial questions of law were kept open for determination in an appropriate case. Therefore, there was no finding on any of the issues raised, nor any reasoning provided by the court concerning the merits of the case. No operative directions were issued regarding the ITAT's order.
What were the facts?
The Revenue, Commissioner of Income Tax, Puducherry, filed a Tax Case Appeal under Section 260A of the Income Tax Act, 1961, against an order dated 17.04.2015 passed by the Income Tax Appellate Tribunal (ITAT), 'C' Bench, Chennai. The appeal pertained to assessment year 2009-10 and challenged the ITAT's findings regarding unexplained credits, business turnover, and investment in construction. The High Court admitted the appeal on substantial questions of law. During the proceedings, the Revenue's counsel brought to the court's attention CBDT Circular No. 17/2019, which stipulates that appeals shall not be filed or pursued if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue submitted that the tax effect in this appeal was below this threshold.
What were the issues?
The Tribunal had to decide four substantial questions of law: 1. Whether the Tribunal was correct in treating unexplained bank credits as business turnover and applying an 8% rate to determine undisclosed business income, when the assessee had declared higher gross profit percentages (14.31% and 20%) in the return? 2. Whether the Tribunal was correct in explaining business income based on bank deposits and setting it off against the cost of construction, thereby explaining the investment in construction? 3. Whether the Tribunal was correct in accepting the sources of investment in building construction as sale proceeds of two properties and a loan from Smt. Vimala Devi, despite the assessee failing to prove creditors before the Assessing Officer and offering new arguments before the CIT(A) regarding property sales, and spreading the construction cost over three years? 4. Whether the Tribunal was correct in not considering unexplained credits under Section 68 of the Income Tax Act, 1961, and aspects of genuineness, identity, and creditworthiness of creditors for deciding the issue of unexplained credit under Section 68? The Revenue argued that the Tribunal erred in its findings on these issues. The judgment does not record specific arguments from the assessee on these points.
