What did the High Court hold?

The High Court dismissed the appeal filed by the Revenue. The dismissal was based on the submission made by the Revenue's learned Senior Standing Counsel that the appeal was not being pursued due to low tax effect, as per Circular No. 17/2019 issued by the CBDT. This circular increased the monetary limit for filing or pursuing appeals before the High Court to Rs. 1 Crore, and the tax effect in this case was below that threshold. Consequently, the substantial questions of law raised by the Revenue were left open. The Court granted liberty to the Revenue to file a petition for restoration of the appeal if the tax effect was found to be above the threshold limit, for hearing and decision on merits. No costs were awarded.

What were the facts?

The Revenue, represented by the Principal Commissioner of Income Tax, Corporate Circle 4(2), Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 24.10.2017 passed by the Income Tax Appellate Tribunal, Chennai 'A' Bench. The appeal pertained to the assessment year 2006-07 and challenged the Tribunal's decision regarding an alleged loan of Rs. 1.70 crores appearing in the books of M/s. Kal Publications Pvt. Ltd. The Revenue contended that the Tribunal erred in considering accounting entries passed after the end of the relevant previous year and in treating the amount as trade advances based on subsequent financial year transactions. The assessee is M/s. Kal Publications Pvt. Ltd.

What were the issues?

1. Whether, on the facts and circumstances of the case, the ITAT was correct in considering accounting entries passed after the end of the previous year relevant to AY 2006-07, ignoring the principle that each Assessment Year is separate and distinct and accounting entries in subsequent years cannot influence the assessment of an earlier year? (Question of law) 2. Whether, on the facts and circumstances of the case, the ITAT was justified in holding that the alleged loan of Rs. 1.70 crores appearing in the books of M/s. Kal Cables Pvt Ltd in F.Y. 2005-06 was trade advances on the basis of transaction entries in the subsequent Financial Year? (Question of mixed law and fact) 3. Whether, on the facts and circumstances of the case, the order of ITAT was perverse, as it decided the issue solely on the basis of the subsequent financial year, ignoring the facts on record for the Financial Year relevant to AY 2006-07? Assessee's contentions: Not recorded. Revenue's contentions: The Revenue argued that the ITAT erred by considering post-year-end accounting entries and by treating the disputed amount as trade advances based on subsequent financial year transactions, thereby rendering the order perverse.
