What did the High Court hold?

The High Court dismissed the appeal filed by the Revenue. The dismissal was based on the Revenue's submission that the appeal was not being pursued due to low tax effect, as per CBDT Circular No.17/2019, which raised the monetary threshold for filing appeals before the High Court to Rs.1 Crore. The Court noted that the tax effect in this case was below the stipulated limit. Consequently, the substantial question of law framed by the Revenue was left undecided. The Court granted liberty to the Revenue to file a petition for restoration of the appeal if the tax effect was found to be above the threshold limit, allowing it to be heard and decided on merits. No costs were awarded.

What were the facts?

The Revenue, Principal Commissioner of Income Tax, Corporate Circle - 2(1), Chennai, filed an appeal before the High Court of Madras against an order dated 01.03.2019 passed by the Income Tax Appellate Tribunal (ITAT), Madras 'D' Bench. The appeal pertained to the assessment year 2013-14 and challenged the ITAT's decision to treat belatedly filed returns as if they were filed within the time limit under Section 139(1) of the Income Tax Act, 1961. The Revenue's appeal was based on a substantial question of law concerning the applicability of a CBDT Circular. However, the Revenue subsequently submitted that the appeal was not being pursued due to low tax effect, citing CBDT Circular No.17/2019 which increased the monetary limit for pursuing appeals before the High Court to Rs.1 Crore.

What were the issues?

1. Whether, on the facts and circumstances of the case and in law, the Tribunal was correct in treating the belated returns of income as if the return was filed within the time limit provided under Section 139(1) of the Act by relying on CBDT Circular F.No.225/117/2013/ITA.II, dated 24.10.2013, when the circular specifically states that the extended due date of 31.10.2013 is applicable only to cases where the audit reports were due to be filed along with the returns? Assessee's contentions: Not recorded in the judgment. Revenue's contentions: The Tribunal erred in relying on the CBDT Circular dated 24.10.2013. The Revenue argued that the circular's extended due date of 31.10.2013 was applicable only to cases where audit reports were due along with the returns, implying the assessee's case did not fall under this specific condition. The Revenue later submitted that the appeal was not being pursued due to low tax effect, citing CBDT Circular No.17/2019.
