COMMISSIONER OF INCOME vs. M/S RM.K.V. TEXTILES
What did the High Court hold?
The High Court did not decide the substantial questions of law on merits. The Revenue brought to the court's notice Circular No.17/2019 issued by the CBDT, which stipulates that appeals shall not be filed or pursued by the Department before the High Court if the tax effect does not exceed Rs.1,00,00,000/-. The learned counsel for the Revenue submitted that the tax effect in these appeals was less than this threshold limit. Consequently, the Court, in light of this submission, dismissed the present appeals as withdrawn. The Court explicitly stated that the substantial questions of law remain open for determination in appropriate cases. No costs were awarded.
What were the facts?
The Revenue (Commissioner of Income Tax) filed these appeals under Section 260A of the Income Tax Act, 1961, challenging the common order dated 01.06.2016 passed by the Income Tax Appellate Tribunal (ITAT), Chennai. The appeals pertain to assessment years 2007-08, 2008-09, and 2009-10, and relate to the assessee, M/s. Rm.K.V.Textiles. The ITAT's order dealt with several issues concerning the valuation of closing stock, deductibility of lease commitment charges, classification of tenancy rights, and treatment of repair and renovation expenditure. The appeals were filed against the ITAT's decision which had granted relief to the assessee on these matters.
What were the issues?
The Tribunal had to decide several substantial questions of law. For T.C.A.Nos.204 and 205 of 2017, the questions were: (i) whether the deduction of an ad hoc provision from the book value of stock to arrive at the closing stock is permissible; (ii) whether the assessee's method of stock valuation is acceptable when it is based on the assessee's perception and not an acceptable accounting standard; and (iii) whether the Tribunal was right in granting relief due to the Assessing Officer's failure to reconcile stock when the assessee also failed to do so during the search. For T.C.A.No.206 of 2017, additional questions included: (iv) whether lease commitment charges paid by a partner individually and later disclosed as donations/business expenditure by the firm are allowable as revenue expenditure; (v) whether tenancy rights acquired through donation are a capital asset under Section 55(2); and (vi) whether the deletion of addition for stock discrepancy was correct when the stock was taken with the assessee's staff's participation and valuation. For T.C.A.No.207 of 2017, the question was: (i) whether Explanation 1 to Section 32 applies to repair and renovation expenditure on leasehold land for interior decoration, flooring, painting, and temporary partitions. The Revenue argued that the ITAT's findings were legally unjustified and incorrect, particularly concerning the stock valuation and the burden of proof on the assessee. The assessee's arguments are not explicitly detailed in the provided text, but the ITAT's favorable findings suggest the assessee contended for the permissibility of their accounting methods and the correctness of the reliefs granted.
