What did the High Court hold?

The High Court noted that the assessee had filed a declaration under the Vivad Se Vishwas Scheme, 2020. In light of this subsequent development, the Court directed the Competent Authority to process the assessee's application/declaration under the Direct Tax Vivad Se Vishwas Act, 2020, and pass appropriate orders expeditiously. The appeal was disposed of with liberty granted to the assessee to restore it if the ultimate decision on their declaration was not in their favour. Consequently, the substantial questions of law framed were left undecided. No costs were awarded.

What were the facts?

The assessee, M/s. Lakshmi Ammal Memorial Trust, filed an appeal before the High Court of Judicature at Madras against an order dated 05.7.2017 passed by the Income Tax Appellate Tribunal (ITAT). Whether, on the facts and circumstances of the case, the Income Tax Appellate Tribunal was right in law in denying exemption under Sections 11 to 13 of the Income Tax Act, 1961 when the property of the trust is exploited for meeting the expenditure towards the objects of the trust? Assessee's Contention: The assessee argued that the running of the kalyana mandapam was an incidental activity and that the trust property was exploited to meet its objects.
