What did the High Court hold?

The High Court, in light of the submission made by the learned counsel for the appellant/Revenue regarding CBDT Circular No. 17/2019, dismissed the present appeals. The court noted that the tax effect in these appeals was less than the monetary limit imposed by the circular. Consequently, the appeals were dismissed as withdrawn. The court explicitly stated that the substantial questions of law were kept open for determination in appropriate cases. No costs were awarded.

What were the facts?

These are four tax case appeals filed by the Revenue against a common order dated 05.06.2015 passed by the Income Tax Appellate Tribunal (ITAT), Chennai. The appeals pertain to assessment years 2002-03, 2003-04, 2005-06, and 2006-07. The High Court had admitted these appeals on specific substantial questions of law. During the hearing, the Revenue brought to the court's attention CBDT Circular No. 17/2019, which stipulates that appeals should not be filed or pursued if the tax effect does not exceed Rs. 1,00,00,000/-. The Revenue submitted that the tax effect in these appeals was below this threshold.

What were the issues?

The High Court was to decide two substantial questions of law: 1. Whether the ITAT was correct in holding that the assessment orders for assessment years 2002-03 to 2006-07, passed on 24.09.2008, were barred by limitation, without considering Clause (ii) of the Explanation to the 6th Proviso to Section 153B of the Income Tax Act, 1961. 2. Whether the ITAT was correct in allowing the assessee to take advantage of a situation arising from his own breach of legal obligations. Contentions: Assessee: No specific contentions are recorded for the assessee in the provided judgment. Revenue: The Revenue contended that the appeals should be dismissed as withdrawn, citing CBDT Circular No. 17/2019, which mandates that appeals with a tax effect below Rs. 1,00,00,000/- should not be filed or pursued. The Revenue stated that the tax effect in these appeals was less than the prescribed threshold.
