SHRI C. ANIMUTHU vs. THE INCOME TAX OFFICER
What did the High Court hold?
The High Court held that the Assessing Authority and the Tribunal had not made any probe into the 'source of the source' but had sought an explanation for the investments made in the two HUFs. The assessee was unable to provide a satisfactory explanation for these investments. The Court found that this was a pure question of fact that had been considered by both the Assessing Authority and the Tribunal, who arrived at the conclusion that the explanation for the source of the investments was not properly explained. Consequently, the High Court found no merit in the appeal. The appeal was dismissed. The Court did not expressly leave any issue undecided.
What were the facts?
The appeal was filed by the assessee, Shri C. Animuthu, against an order of the Income Tax Appellate Tribunal (ITAT). The Revenue, represented by the Income Tax Officer, Ward 1(1), Pudukottai, was the respondent. The assessment year in question is 2003-04. The appeal challenges the ITAT's decision to sustain an addition of Rs. 20.50 lakhs. The ITAT had restored the order of the Assessing Officer, reversing the order of the CIT(A) which had deleted this addition. The ITAT found that the unexplained income admitted by the assessee was neither retracted nor included in any return filed. The assessee's claim that a portion of this income was received by family members for investment in an HUF joint venture was not corroborated. The High Court noted that the assessee's counsel reported 'no instruction'.
What were the issues?
1. Whether the appellate Tribunal is correct in law in sustaining the addition of Rs. 20,50,000/- being the investments made in two partnership firms from the monies received from the appellant’s HUF account on the consideration of Section 69 of the Act in the computation of taxable total income forming part of the re-assessment order framed for the assessment year 2003-04 even though there is no statutory mandate vested with the respondent to probe into source for source in the present assessment proceedings. Assessee's Contention: The assessee argued that the Revenue had no statutory mandate to probe into the source of the source of funds for the investments made in the HUF account, particularly in the context of Section 69 of the Income Tax Act, 1961. The investments were made from the appellant's HUF account. Revenue's Contention: The Revenue contended that the assessee failed to provide a satisfactory explanation for the source of the investments made in the two HUFs. The Tribunal had found that the unexplained income admitted by the assessee was not retracted and not included in any filed return. The claim regarding family members receiving funds for investment in an HUF joint venture was not substantiated by any documents.

On perusing the materials placed before us and Section 69 of the Act, which deals with unexplained investments, while computing taxable total income, we find that the Assessing Authority has not made any probe into source of the source, but had sought for an explanation for the investments made in the two HUFs, for which the assessee was not able to provide satisfactory explanation. It is a pure question of fact, which has been considered by the Assessing Authority as well as the Tribunal, and both have arrived at the conclusion that the explanation for the source of the investments made by the assessee in the two HUFs was not properly explained. We find no merit in the appeal. Hence, this Tax Case Appeal stands dismissed. No order as to costs. (G.JAYACHANDRAN, J.)
