What did the High Court hold?

The High Court did not decide the substantial questions of law framed for consideration. This was due to subsequent developments, specifically the enactment of the Direct Tax Vivad Se Vishwas Act, 2020. The learned counsel for the assessee informed the Court that the assessee had been issued Form-3 under this Act and sought permission to withdraw the appeal. Consequently, the High Court dismissed the Tax Case Appeal as withdrawn. No specific finding was given on the merits of the substantial questions of law, nor was any ratio decidendi established for future reference on those points. The operative direction was the dismissal of the appeal as withdrawn.

What were the facts?

The assessee, Prof. K. Radha Shanmugasundaram, filed an appeal against an order of the Income Tax Appellate Tribunal (ITAT), Madras 'A' Bench, dated 04.07.2014, pertaining to assessment year 2006-07. The appeal was admitted by the High Court of Judicature at Madras on 30.03.2015. The dispute revolved around the computation of Long Term Capital Gains (LTCG) arising from a joint development agreement dated 28.04.2005. The High Court was informed that the assessee had been issued Form-3 under the Direct Tax Vivad Se Vishwas Act, 2020, and consequently sought permission to withdraw the appeal.

What were the issues?

1. Whether the Tribunal was correct in law in holding that the transfer arising from the joint development agreement dated 28.04.2005 falls within the scope of Section 2(47) of the Income Tax Act, 1961, for the purpose of computing Long Term Capital Gains for assessment year 2006-07? 2. Whether the Tribunal was correct in law in approving the computation of Long Term Capital Gains based on a deemed transfer under Section 2(47) of the Act, by adopting a notional value for the cost of construction to be borne by the developer in lieu of the undivided share of land, without considering the provisions of Section 50C of the Act? Assessee's Contention: The assessee sought to withdraw the appeal. Revenue's Contention: Not recorded in the judgment.
