THE COMMISSIONER ON INCOME T vs. M/S. ENNORE PORT LIMITED
What did the High Court hold?
The High Court dismissed the appeals as withdrawn on account of low tax effect, as per the submissions made by the Revenue. The Court noted that the tax effect in these cases was below the threshold limit stipulated in CBDT Circular No.17/2019. Consequently, the substantial questions of law framed for the appeals were left undecided. The Court granted liberty to the Revenue to seek restoration of the appeals if the tax effect was found to be above the threshold limit, allowing them to be heard and decided on merits. No costs were awarded.
What were the facts?
The Revenue, Commissioner of Income Tax, Chennai, filed two appeals (T.C.A.Nos.154 & 155 of 2016) against the orders of the Income Tax Appellate Tribunal (ITAT), Chennai, dated 29.11.2011. These appeals pertained to Assessment Years 2002-2003 and 2003-2004 and concerned M/s. Ennore Port Limited as the respondent assessee. The appeals were filed under Section 260A of the Income Tax Act, 1961. The core of the dispute involved the allowability of depreciation on expenses incurred for setting up a breakwater and port creation charges.
What were the issues?
The Tribunal had to decide two substantial questions of law: 1. Whether, on the facts and in the circumstances of the case, the ITAT was right in holding that depreciation on expenses incurred in connection with setting up of a breakwater in the port was allowable even though it did not form part of the block of assets eligible for depreciation. 2. Whether, on the facts and in the circumstances of the case, the ITAT was right in holding that depreciation on port creation charges should be treated as plant and machinery and allowed at the applicable rates (25% or 10% for buildings). The Revenue's contention, as presented to the High Court, was that these appeals were not being pursued due to low tax effect, citing CBDT Circular No.17/2019 which increased the monetary limit for High Court appeals to Rs.1 Crore. The judgment does not record specific arguments made by the assessee or the Revenue before the ITAT on the merits of the depreciation claims.
